ACL as Applied Law Diagram CCA Schedule 2, s1: 1 Application of this Schedule This Schedule applies to the extent provided by: (a) Part XI of the Competition and Consumer Act; or (b) an application law
In the ACL (CCA Sch 2 Ch 1 s2), application law is defined as: application law has the same meaning as in section 140 of the Competition and Consumer Act, found in Part XIAA.
Part XIAA, s140: application law means: (a) a law of a participating jurisdiction that applies the applied ACL, either with or without modifications, as a law of the participating jurisdiction; or (b) any regulations or other legislative instrument made under a law described in paragraph (a); or (c) the applied Australian Consumer Law, applying as a law of the participating jurisdiction, either with or without modifications. . Section 140:
Applied Australian Consumer Law means
(according to the context): (a) the text described in section 140B; or (b) that text, applying as a law of a participating jurisdiction, either with or without modifications.
140B The applied Australian Consumer Law The applied Australian Consumer Law consists of: (a) Schedule 2; and (b) the regulations made under section 139G of this Act.
CCA Part XI s130: Australian Consumer Law means Schedule 2 as applied under subdivision A of Division 2 of this Part.
