CRIMINAL LAW 2021-22 BOOKLIST (Revised) Topic Outlines and distributed materials will generally guide you on the topics and materials you need to be familiar with. In accordance with Departmental policy, these materials will be uploaded to Moodle and not otherwise printed or distributed (note: handouts used in lectures may also be printed and distributed in hardcopy at lecture). As far as HK textbooks are concerned, you have a choice of two (others are much too costly): - M Jackson, Criminal Law in Hong Kong (HKU Press, Jan 2003). (Regrettably, this textbook is now out-of-date, and a new edition is unlikely to be available during the current academic year. However, you may wish to acquire a copy as a general reading resource on Hong Kong’s criminal law. In general, the Topic Outlines will refer you to the relevant law and also (where appropriate) to relevant passages in this text) - Simon So, Criminal Law in Hong Kong (Lexis Nexis, July 2020) (This recent publication contains a useful summary of the HK criminal justice system and a relatively more up-to-date account of the criminal law in HK, including an outline of key offences against the person and against property, and a range of other offences. It also contains references to various Chinese language judgments, which are now more common, and some of which provide additional guidance on the substantive law. Note however that some of the topics to be covered during the course are not comprehensively addressed in this text, some of its content is heavily derivative or inaccurate (in particular, its discussion of participation liability is misplaced in the chapter on Inchoate liability), and discussion often lacks analytical depth. Cost is likely prohibitive, and suggest you only consider purchasing if you can get a cheap second hand version) S Young, The Essential Statutes on Hong Kong Criminal Law and Procedure (2008, published by LexisNexis Butterworths). (Note: we will refer to statutory materials in lectures and tutorials/seminars, and students will be expected to have copies of the relevant statutory materials. No statutory materials will be provided to students in the examinations – students will, therefore, need to have their own copies of relevant statutory provisions (which may be annotated etc) and bring these to the examination) English law The following resources may also be valuable to students, but you should note they concern English criminal law. English criminal law provides the foundations of HK’s criminal law, and many aspects of general doctrine remain a matter of common law, especially relating to the general construction of criminal liability, various common law offences (such as murder, manslaughter, assault and battery), and general defences – as such, the discussion in these texts remains generally applicable in HK. offences (such as sexual offences, incitement) no longer provide direct guidance on Hong Kong law. (Note: because of these statutory changes, previous editions of these textbooks are usually just as useful as a general resource on HK law) - Smith, Hogan & Ormerod, Essentials of Criminal Law (ed. Child & Ormerod), (3rd revised ed. OUP, 2019) [this offers a student-centred approach to English criminal law, which is more accessible than the author’s full textbook below, and at a slightly cheaper price (currently @ $390)] - Smith, Hogan & Ormerod, Criminal Law, 16th ed. (ed. David Ormerod & Karl Laird), (OUP, Butterworths, 2021) [or earlier edition] [this has been regarded for many years as perhaps the leading general English criminal law textbook; it is priced at about $450, but second hand copies of earlier editions should be available at a cheaper price] - AP Simister, JR Spencer, GR Sullivan & GJ Virgo, Simister & Sullivan’s Criminal Law: Theory & Doctrine, 7th ed. (Hart Publishing, 2019) [or earlier edition] [priced about $4000 for print version, but also available in cheaper eBook version; second hand copies of earlier editions should be available at a cheaper price). This text offers a valuable theoretical account along with detailed discussion of the substantive law - Dennis Baker, Glanville Williams Textbook of Criminal Law, 4th ed. (Sweet * Maxwell, 2015) (currently @ $355). This is a traditional textbook, but adopts a Q&A format which you may find useful. There are also many other textbooks on English Criminal law you could purchase, ranging from those which are heavily ‘principle-based’ (eg. Ashworth & Horder, Principles of Criminal Law, 9th ed. (OUP, 2019), $360), to others in the nature of ‘nutshells’. As with the above texts, earlier editions may be as broadly useful as the most recent editions. But keep in mind that you will ultimately be tested on HK law, and reliance on English materials (especially ‘nutshells’) will likely be inadequate.
