Under the Ohio syndicalism statute, Brandenburg was convicted as the leader of the Ku Klux Klan. His conviction revolved around the statute of “advocating crime, sabotage, violence, or unlawful methods of terrorism as a means of accomplishing industrial or political reform.” The significance of this case and the court concentrates on the fourteenth and first amendment; right to freedom of speech. The issue at hand was whether or not the Statute prohibited the defendants right to free speech in violation of his first amendment right. In order for the case to uphold the exclusion of speech in the incitement to violence, the court had to prove that Brandenburg expressly advocated violence, immediate violence and incited violence to occur....
