BRIEF TO COUNSEL

Counsel is instructed to prepare representations in the matter of ABC. We enclose the following : 1) Judgement of Royal Courts of Justice dated Monday 19th March 2012. The evidence submitted in support of the case was by way of copies. Some of the copies provided were deemed “very poor copies of photocopied documents which are difficult to read and sometimes impossible to understand”. The original documents were in the possession of the court in Pakistan where the case regarding the murder of the client’s brother is pending. In light of the judgement the file was requested which contained the original documents and in turn this has been sent to the UK.

Summary of the documents received:-

Letter from Advocate, XYZ dated 26th March 2012 requesting release of file papers from the Court which includes returning the original documents. The bundle presented before the court contained photocopies of documents. Some of the photocopies were understandably not very clear. It is for this reason that a request to return the original papers was submitted. Upon receipt of the complete file, the same was forwarded to the client.

Letter sent to client’s father by his Advocate confirming that a formal request for the file and original documents has been submitted to the Court.

Certificate dated 21st April 2012 from the client’s father advocate explaining the reasons for errors on the documents.

‘Application form for death registration’- There was confusion as to whether the year of death is 2008 or 2009 as it was not entirely clear from the copy. The date of death is 5th November 2009. We have been forwarded the original ‘Post Mortem Examination Report’ dated 5 November 2009’. This has been attested and signed. We have also been forwarded the death certificate signed and attested.

Document from the Client’s father- ‘Request for Justice and Protection’. The photocopy of this document submitted contained an error with the date of death. It was incorrectly stated as 10 September 2009. This was the date that the attack took place and the date that injuries were sustained by the client’s deceased brother as earlier stated in the same document. The date of death is 5th November 2009. We have been forwarded the duly amended original document with attestation.

Certificate from the Advocate confirming that he has been appointed to act on behalf of the client’s father. The original document forwarded is dated and attested....
