Education Supervision Orders If parents did not comply with their duties under the Education Act 1944 the LA had to consider whether, as an alternative to prosecuting the parents, a care order would be more effective. The view of the Children Act is that care proceedings are inappropriate in this type of situation – hence the education supervision order (ESO)
s36(1) The Local Education Authority has the power to apply for an education supervision order s36(3) The ground for such an application is solely that the child is of compulsory school age and is not being properly educated s36(4) A child is not being properly educated if he is not receiving full time education suitable to his age, ability and aptitude and any special educational needs he may have.
