Felthouse v Bindley In that case Felthouse, wrote a letter to his nephew to buy his nephew’s horse for USD 30, saying, “If I hear no more about this offer, I shall consider that the horse is mine at USD 30.” The nephew did not reply, but he told the auctioneer (Brindley) who was selling the horse not to sell that particular horse because it was sold to his uncle. By mistake, the auctioneer sold the horse. Felthouse then sued the auctioneer arguing that the horse belonged to him.
