Caption: Leonard v. Pepsico, Inc. Citation: 210 F. 3rd 88 (S.D. N.Y. 2000) Action: This case is an example of a contract issue. Leonard, the plaintiff, sued Pepsico, Inc, the defendant, because he believes that the company breached the contract in not rewarding Leonard for the Harrier Jet which he presumed was offered in the advertisement for collecting a certain amount of points. Facts: Leonard saw a Pepsi advertisement that showed the people earning points through Pepsi products and exchanging them for merchandise. At the end of the advertisement it showed a Harrier Jet the indicated price of 7,000,000 Pepsi points. The advertisement also showed that you can buy points for ten cents. Leonard collected an equivalent of 7,000,000 points and sent it in to Pepsi Co, Inc. The request was denied and Leonard in turn sued for a breach of contract. Issue: Is the advertisement an example of an offer or an invitation to negotiate? Opinion of the Court: The court ruled in favor of Pepsi Co, Inc. because the advertisement is not an offer. Additionally, the court noted that the reasonable man would not believe that a Harrier Jet would be a prize to actually win....
