Q2: You are the manager of an upcoming TV channel named “MIS broadcast”. You are responsible for the establishment and licensing of the channel. The CEO of “MIS broadcast” has requested you to apply for the license on behalf of the channel. Where should you apply? What should you do and what is the licensing procedure? Ans: There was a time when the only TV channel we had was BTV, sometimes DD National of India. Having cable tv networks was luxury, but we have come a long way from there. And so is our television industry. We have about 44 licensed private TV channels in Bangladesh, more than 30 of them broadcasts. That’s why, Government has formulated necessary policies to make this industry more profitable and successful. Such policies cover from licensing to conducting. Not only that, concerned organizations have been established too, such as: BTRC. For establishing a TV station, firstly, I need to get two vital permissions or licenses. The first one is from the Ministry of Information of our country. Because they are the one who provides licenses for satellite TV Broadcasting. Therefore, I will approach them first for a license of “MIS Broadcast”. Next, after I get permission from the Ministry of Information, I’ll apply for assignment of frequency from Bangladesh Telecommunication Regulatory Commission (BTRC). My application will be for both frequency assignment and import of Earth Station and SNG/DSNG equipment to BTRC. After getting assigned frequency, I’ll import radio equipment by getting prior permission from BTRC. According to the National Frequency Allocation Plan, BTRC will assign me 6/9/12 MHz uplink frequency from 5.85- 6.425 GHz band. Now, I will find the application form which is available on the website of BTRC. It has to be filled up with proper information. Then, with the form filled-up duly, the other documents which needs to be attached with it has been given below: ❖ Letter of application to the Chairman of BTRC in attention to the Director of Spectrum Division. ❖ Attested Copy of License from Ministry of Information. ❖ Attested Copy of Brochure (General Specification) of requested radio equipment. ❖ Attested Copy of Trade License. ❖ If ours is a limited company, then, Attested Copy of Memorandum of Association and Article of Association. ❖ If ours is a public company, then, Attested Copy of Proprietorship Certificate.

For submitting No Objection Certificate, one has to submit documents for both prior permission and custom clearance. These will include a list of equipment, attested master air waybill (MAWB), invoice and packing list. After that, I’ll have to submit nonrefundable BDT 6325/= to the commission in the form of bankdraft/pay-order for us in favor of Bangladesh Telecommunication Regulatory Commission. This fee includes: ❖ Application form fee – BDT 500/= ❖ Application processing fee – BDT 5000/= ❖ VAT 15% - BDT 825/=

After getting the application with proper documents, the Commission will forward the application to the Spectrum Management Committee. The Committee will then recommend the proposal to the Commission. According to the Commission’s decision, our channel “MIS Broadcast” will be assigned spectrum. Finally, we will test run the assigned spectrum for 7days. After 7 days, we will submit the Test Transmission report to the Commission. And then the inspection team from BTRC will inspect our broadcast method. Then they will award us a license to operate radio communications equipment. The license has to be renewed on a yearly basis. So, this is how I can license the channel “MIS Broadcast”....
