Mock Trial Tryout Reference Sheet Objections Speculation ● Testimony commenting (or speculating) on something a witness doesn’t have first hand knowledge of, including but not limited to drawing inferences from facts. Narrative ● Witnesses: a lengthy response unduly out of the scope of the question asked. ● Attorneys: asking a question with an unreasonably large scope. Outside of the Scope ● Witness: including evidence not pertinent or related to the question asked. ● Attorneys: asking questions regarding a topic NOT mentioned in cross or re-direct. Badgering ● When the attorney is being overly aggressive toward the witness on cross. Improper Opinion ● Testimony that is BOTH unfounded and given by an unprofessional. ● Witnesses can give professional opinions if proper foundation is laid. Asked and Answered ● Repeating a question solely for the purpose of dramatic effect. Relevance ● “‘Relevant evidence’ means evidence having any tendency to make the existence of any fact that is of consequence to the determination of the action more probable or less probable that it would be without the evidence.” ● When the witness testimony or attorney’s question isn’t relevant Lack of Foundation: ● Testimony that assumes certain facts that have not been offered into evidence. Argumentative ● Questions or testimony that have potential to induce prejudice onto the jury Leading Question ● A question that implies the answer within itself. Ultimate Question
