COMMERCIAL LAW MOCK EXAMINATION EXERCISE INSTRUCTIONS As you know, the January (Summative) exam in Commercial Law is a part-seen examination. You are presented with an Initial Briefing, which outlines four scenarios (questions) with those scenarios being developed by additional information provided in the examination itself. This formative exercise is designed to give you an opportunity to practice the processes involved in the summative examination and make sure you are able to get the most out of our Exam Workshop in Week 12. PART 1: Review the Mock Examination Initial Briefing available on VITAL (Assessment). Select one of the four scenarios and reflect on the following questions:  What legal issues are raised in your chosen scenario?  What ambiguity or uncertainty exists in your chosen scenario?  What does the question signpost as being outstanding information, to be provided later (i.e. in the Mock Examination Paper)?  What areas of law would you include within the notes you are permitted to take into the exam? PART 2: Review the Mock Examination Paper available on VITAL (Assessment). With reference to your chosen scenario, consider the following:  How, if at all, does the additional information provided in the Mock Exam Paper modify your scenario? What is its effect?  Notwithstanding the additional information, what, if any, ambiguity or uncertainty remains? How would you deal with that in your answer?  Draft an outline answer to your chosen scenario. FEEDBACK: We will review all of the questions from the Mock Examination in the Exam Workshops scheduled for Week 12. In those sessions we will focus on issues both of technique, which you are asked to reflect on above, and also the substantive legal issues raised. After the Exam Workshops I will post my outline answers for all four scenarios will be posted to VITAL....
