Variation of the Lease

5.1

Subject to completion of the assignment in accordance with the provisions of this deed: (a)

the definition of Permitted Use in the Definitions clause of the Lease shall be deleted and replaced by the following: “Permitted Use means use as a retail shop for the sale of music and music DVDs or such other retail shop use (excluding the sale of food) as is within use class E(a) of the Town and Country Planning (Use Classes) Order 1987 as at the date this Lease is granted as the Landlord may approve (such approval not to be unreasonably withheld or delayed).”

(b)

with effect from and including the date which is 10 weeks from the date of completion of the assignment, the definition of Rent in the Definitions clause of the Lease shall be deleted and replaced by the following: “Rent means rent at an initial rate of fifty two thousand five hundred pounds (£52,500) per annum and then as revised pursuant to this Lease.”

5.2

Save as varied by this clause 5, the Lease shall continue in full effect and force.

5.3

The Assignee’s application to register the assignment referred to in clause 17 of this deed shall include an application to note this deed on the registered title of the Lease. ********
