Evaluate the following scenarios, both by applying the law, and by thinking about what might be good or bad about it in light of them 1) Anfisa wants to kill Betty. She manages to buy a gun illegally from her friend Dave. She drives to Betty’s workplace and waits outside in the bushes. Milly, who looks like Betty, comes out of the building. Anfisa is just about to pull the trigger, but then realises that it’s not Betty, so she stops. Actus reus and mens rea. > attempt is there. 2) Wolfgang wants to kill Mark. He buys a length of rope and some chloroform. He intends to drug Mark, take him to his basement, torture him for a few days and then murder him. He goes to Mark’s flat, breaks in, and drugs Mark. He drags his body to his car. But a police officer who has been tipped off then intervenes to save Mark. Dagnall case referred. More than merely preparatory. 3) Sofia has long suspected that her friend, Margo, is having an affair with her husband, and that they are meeting in Sofia’s house at lunchtimes. Margo drives a blue Porsche. Sofia decides to come home from work at lunchtime, and she sees a blue Porsche on the drive. She flies into a rage and smashes it up with the golf clubs in the back of her car. She then storms into the house, but finds out that her husband has bought her the Porsche as a gift, as he saw how much she liked Margo’s. 4) Billy tries to have sex with Karl. He fails to achieve penetration. He is unsure whether Karl is consenting to sex, because he doesn’t communicate clearly with Billy. Does it make any difference whether Karl is in fact consenting?...
