What is the difference between “commercial” and “residential” tenancies?

Residential is living accommodations [ RTA]. Commercial tenancies [commercial tenancies act].

2. Can parties contract out of the Residential Tenancies Act? No , s.3(1); s.4.

3. Identify four situations when the RTA does not apply. Hotel , lodge or resort. Employed by a farm. Non profit housing . Penal and correctional purposes. This is stated is s.5 , s.6 , s.7.

4. What is the difference between an “assignment” and a “subletting” of a residential tenancy? Sublet – when you have a tenant and subtenant [ the tenant is responsible because they sign a lease]. The tenant has to move out. Has to before the term ends. Assignment – transferring the remainder of your tenancy to someone else. Both of these you need reasonable consent from the landlord.

5. Bob signed a lease for an apartment commencing July 1, 2015 and ending June 30, 2016. On August 15, 2015 he is told he is being transferred permanently to Australia. He finds someone to take over the lease and leaves for Australia. Would Bob likely be assigning the lease or subletting the apartment? Assigning the lease because he is transferring the remainder of your tenancy to someone else [transferring it permanently]
