Factories & Industrial Undertakings (F&IU) Ordinance (Cap. 59)

1.1.

Factory / Industrial Undertaking 'Factory' means any premises or place, (other than a mine or quarry), in which articles are manufactured, altered, cleaned, repaired, ornamented, finished, adapted for sale, broken up or demolished or in which materials are transformed, and within the close or curtilage or precincts of which: a) any machinery other than machinery worked entirely by hand is used; or b) 20 or more persons are employed in manual labour. 'Industrial Undertaking' includes: a) any factory; b) any mine or quarry: c) any industry in which articles are manufactured, altered, cleaned, repaired, ornamented, finished, adapted for scale, broken up or demolished, or in which materials are transformed, including shipbuilding; d) the generation, transformation, and transmission of electricity or motive power of any kind: e) any construction work; f) the loading, unloading, or handling of goods or cargo at any dock, quarry, wharf, warehouse or airport; fa) container handling; g) the carriage of coal, building materials, or debris; h) the transport of passengers or goods by road, rail, cable-way or aerial rope way; i) the preparation of food for consumption and sale on the premises where it is prepared; j) any premises or site in or upon which, and the machinery, plant, tools, gear and materials with which any of the foregoing industrial undertakings is carried on. None of the above provisions of Cap. 59 shall apply to: a) any undertaking which is not carried on by way of trade or for purposes of gain; or b) any agricultural operation.

1.2.

General Duties Sections 6A and 6B under Cap. 59 put general duties on safety and health on proprietors and employees. Section 6A(2) requires proprietor to ensure, so far as is reasonably practicable, the health and safety at work of all persons employed by him at the industrial undertakings. These include in particular: a) the provisions and maintenance of plant and systems of work that are safe and without risks to health; b) arrangements for ensuring safety and absence of risks to health in connection with the use, handling, storage and transport of articles and substances; c) the provision of information, instruction, training and supervision to ensure health and safety at work of all persons employed; d) the maintenance of workplace to a condition that is safe and without risks to health and the provision and maintenance of means of access to and egress from it that are also safe and without health risks; and e) the provision and maintenance of a working environment that is safe and without risks to health. Section 6B, on the other hand, is general duties for employees which are: Page 1 of 13

to take reasonable care for the health and safety of himself and of other persons who may be affected by his acts or omissions at work; to cooperate with the proprietor to enable that duty or requirement on health and safety are complied with.

According to Section 6BA, • proprietor of construction work and container handling shall only employ persons who are issued with valid certificate to carry out construction work or cargo container handling. • person employed to carry out construction work or cargo container handling shall carry the certificate with him at work in the industrial undertaking. 2.

Factories & Industrial Undertakings Regulations (Cap. 59A), F&IUR This set of regulations lists certain general safety requirements at industrial undertakings such as: housekeeping, cleanliness, ventilation, lighting, drainage of floor, overcrowding in workplaces, sanitary conveniences, supply of drinking water, etc. It also requires medical examination of persons employed to work underground, report of accidents and dangerous occurrences, power of officers to take samples, registration of workplaces, prevention of and escape from fire, prevention of accidents, etc. Fencing All platforms, pits and openings in floors and other potentially dangerous places and all vessels containing scalding, corrosive or poisonous liquids must be securely fenced to a height of at least 900mm or otherwise protected in a satisfactory manner. Housekeeping All floors, walls, ceilings, windows and skylights must be maintained in good condition. Floor surfaces must be non-slippery, free from obstruction or tripping hazard. All goods and materials must be stored in a proper manner so as to prevent occurrence of accidents. Cleanliness Every workplace must be kept clean. Accumulation of dirt and refuse must be removed daily from floors and benches. The floor of every workroom must be cleaned at least once a week. All inside walls, partitions, and ceilings must be washed with hot water and soap every 14 months if oil-painted or varnished or otherwise, limewashed once a year. A record on the surfaces which have been limewashed, oil-painted and varnished, and the name and address of each person who carried out such work and the dates shall be maintained and shall be produced for inspection when required by the Occupational Safety Officer. Overcrowding Each workroom must provide at least 7 cubic metres (250 cubic feet) of space for every person employed. A notice must be posted in each workroom specifying the number of persons allowed to be employed in it. Ventilation Adequate ventilation of workrooms must be secured by the circulation of fresh air. Where dusts of fumes likely to be injurious or offensive are given off, all practicable measures must be taken to protect the workers against inhaling dust or fumes and, where practicable, local exhaust ventilation must be provided and maintained. Lighting There must be adequate lighting in every workplace. Drainage of floors Adequate means for draining the floor must be provided where wet processes are carried out. Sanitary accommodation Page 2 of 13

Adequate sanitary conveniences, separate for each sex, must be provided. Drinking water An adequate supply of drinking water from either a public main or a source approved in writing by a health officer must be provided and maintained at suitable points conveniently accessible to all persons employed. Washing facilities Sufficient and suitable washing facilities, separate for each sex, must be provided. Dangerous Occurrence Every dangerous occurrence shall be reported to Labour Department (LD) within 24 hours in writing which shall include the particulars of the time of the occurrence of the accident, any damage to any building, machinery or plant and the circumstances in which the accident occurred. Specified dangerous occurrence includes: 1) Bursting of a revolving vessel 旋轉器皿, wheel, grindstone or grinding wheel moved by mechanical power. 2) Collapse or failure of a crane 起重機, derrick 吊臂起重機, winch 絞車, hoist 吊重機 or other appliance (but not including a builder's lift or tower working platform to which the Builders' Lifts and Tower Working Platforms (Safety) Ordinance (Cap. 470) applies) used in raising or lowering persons or goods or any part thereof (except the breakage of chain or rope slings), or the overturning of a crane. Explosion or fire causing damage to the structure of any room or place in which persons are employed, or to any machine or plant contained therein and resulting in the complete suspension of ordinary work in such room or place. 3) Electrical short circuit or failure of electrical machinery, plant or apparatus, attended by explosion or fire or causing structural damage thereto, and involving its stoppage or disuse. 4) Explosion of a receiver or container used for the storage at a pressure greater than atmospheric pressure of any gas or gases (including air) or any liquid or solid resulting from the compression of gas. 5) Collapse in whole or part from any cause whatsoever of any roof, wall, floor, structure or foundation forming part of the premises of an industrial undertaking in which persons are employed. 6) Total or partial collapse of any overburden 覆蓋層, face 工作面, tip 尖端 or embankment 築堤 in a quarry. 7) Overturning of, or collision with any object by, any bulldozer 推土機, dumper 傾卸車, excavator 挖土機, grader 平土機, lorry or shovel loader 鏟泥搬土機, or any mobile machine used for the handling of any substance in a quarry. 3.

F&IU (Blasting by Abrasives) Special Regulations (Cap. 59C) These regulation prohibit the use of sand or material containing free silica for blasting.

F&IU (First Aid in Notifiable Workplaces) Regulations (Cap. 59D) These regulation apply to all general industrial undertakings except where there are specific requirements on first aid provisions. It requires the provision of one first aid box with appropriate and sufficient first aid supplies for each 100 employees therein. It also requests inclusion of first aider in the team and the conditions where such requirement may be exempted. Additional requirements are: • the first aid boxes and supplies shall be placed in the charge of a team of responsible persons designated by the proprietor; • at least one member of such team is always readily available during working hours; • the names of the members of the team designated to be in charge of the first aid boxes shall be given in a notice in Chinese and English on the first aid boxes; and • at least one member of the team shall be trained in first aid of each 100 employees or part thereof employed therein after the first hundred. Construction Sites (Safety) Regulations (Cap. 59I) These regulations control the construction, maintenance, use and operation of hoists, scaffolds, and working platforms. • Definition of construction site, competent person and competent examiner • Use of lifting appliances, special provision as to hoists, carrying of persons and securing of loads on hoists. • Construction and maintenance of scaffolds. • Provisions for safe places of work, construction of working platforms, gangways, runs, construction maintenance and use of ladders and folding step-ladders. • Prevention of falls and provisions of safety nets and belts, safety requirement for excavations. • Prevention of inhalation of dust and fumes. • Protection from falling materials. • Provision of first aid facilities. • Keeping of records. • Excavations on construction sites • Miscellaneous Safety Requirements • Notification of Construction Work • General Health and Welfare Requirements

F&IU (Abrasive Wheels) Regulations (Cap. 59L) This set of regulations ensures safety in the mounting and use of abrasive wheels. Users must receive appropriate training before they are allowed to mount the wheel. Certain safety precautions are also required including the speeds of spindles, machine control and responsibilities of employees, etc. An abrasive wheel shall be provided with a guard while in motion and shall: • be so designed and constructed as to contain every part of the abrasive wheel in the event of its fracture; • be properly maintained and secured; and • enclose the whole of the abrasive wheel except such part as is necessarily exposed for the purpose of work being done at that abrasive wheel.

F&IU (Guarding and Operation of Machinery) Regulations (Cap. 59Q) This set of regulations requires that seventeen specifically identified dangerous parts of machinery or plants, or any combination of them, shall be effectively guarded. In addition, there are some thirteen types of machine including washing machines and garment presses that are forbidden to be used by young persons without supervision. These regulations control: • Guarding of dangerous parts and the method of guarding • Allowing openings on fixed guards • Installation of starting and stopping devices • Push button controls to have emergency stopping devices, stock bars, belts and pulleys • Responsibilities of employers, employees and other persons, etc.

F&IU (Protection of Eyes) Regulations (Cap. 59S) Proprietor has to provide suitable protection for the eyes of his employees in certain industrial operations known to be particularly dangerous to the eyes. Some examples of such operations are: dry grinding of metal articles by revolving wheel, band or disc; welding; the handling of acids, alkalis, dangerous corrosive materials, and other substances injurious to the eyes; etc.

F&IU (Noise at Work) Regulation (Cap. 59T) This set of regulations specify the following. • Noise exposure standards for employees • Assessment of noise exposures • Warning notice for ear protection zone in workplaces • Appropriate ear protectors provided where the employees are likely to be exposed to 90 dB(A) of noise • Power to approve ear protectors • Reduction of noise exposure • Maintenance of equipment • Provisions of information to employees

F&IU (Fire Precautions in Notifiable Workplaces) Regulations (Cap. 59V) Proprietor has to follow the requirements on the design of doors, maintenance of fire escapes, provision of fire-fighting equipment, banning of smoking, control of alterations and additions to physical structure of premises, storage of inflammable substances, control of source of ignition, prevention of escape of vapours, etc.

F&IU (Carcinogenic Substances) Regulations (Cap. 59AA) This set of regulations bans the manufacture and use of four chemicals known to induce cancer on users on prolonged contact. In addition, six chemicals which have similar hazards but in lesser severity are classified as controlled substances where their uses are put under specific safety conditions such as medical examination and special safety precautions specified by the Commissioner for Labour.

Proper labels are required for more than two hundred chemicals listed in the regulations. Label should contain identity of chemicals (chemical name, trade name of common name), symbols, risk phrases and precaution phrases. There are also requirements on the size and design of the labels as well as the location where they should be adhered. Furthermore, the proprietor is responsible to provide information, safety training, and supervision to its employees in using the chemicals. Personal protective equipment is to be provided and used by the employees where appropriate. There is prohibition of smoking, drinking and eating in premises where such chemicals are in use. 23.
