FACTS Virat and Indu met each other in India in March 2015 when Virat was visiting for his friend’s wedding. Indu was friends with the bride and they met each other at the pre-wedding ceremony. Virat falls in love with Indu immediately. Virat Singh was born in India but moved to Melbourne with his parents and two older siblings when he was 3 years’ old. He is now 28 years’ old and in good health. Most of his extended family live in various cities across Australia, including in Melbourne. Virat is a car mechanic and works in the family’s car repair business. Virat’s father, Usman, started the business shortly after they arrived in Australia. However, his health has recently been in decline and it is anticipated that Virat will take over the business in the near future. Indu is 22 years’ old. She was born in India and lived there all her life prior to her marriage to Virat. She was born into a poor family and, as the oldest of 6 children, she worked hard helping her mother with the household chores and caring for the younger children. She did not have an opportunity to go to school and has limited literacy. Her fluency in English is also very limited. Indu is very taken by Virat’s charm, charisma and Westernised style. When Virat proposes to Indu, she accepts immediately. She is desperate to leave India and the poverty of her family but is also nervous about whether she could adapt to living in Australia. Due to the decline in Usman’s health they decide to get married as soon as possible. The wedding takes place in India on 15 June 2015. Indu comes to Australia on a spousal visa with Virat 2 weeks later. She is quite anxious. Things start off well in the marriage, although Indu doesn’t like going out of the home and finds it difficult to understand Australian English and cultural mannerisms. Within the first year, on 1 May 2016, their child Ahmed is born. Initially they are very happy. However, after about 3 months Indu starts to withdraw. She often does not get out of bed in the mornings or do the household chores, cooking and cleaning that she had previously attended to. She often locks herself in her room for hours and Virat hears her crying or talking on the phone to her mother in India. Virat is concerned that Indu may be suffering post-natal depression. Their relationship suffers. Indu on the other hand can’t stand the constant interference from Virat’s mother and sister. She feels they constantly criticise her domestic abilities and her lack of creativity in cooking. When they start rebuking the way she cares for Ahmed, it becomes too much for her to withstand and she retreats to her bedroom. Usman passes away 2 years later. Virat takes over the business and is hardly at home anymore. The situation becomes intolerable for Indu. In November 2018 Indu decides to take action. One morning when Virat is at the workshop, she packs her bags and Ahmed’s bags and goes to stay at a women’s shelter. Virat comes home that night to find the home empty. He is frantic because Indu almost never leaves the house. He checks the bedrooms and sees that her clothes are missing. He also notices that the safe is open and that Indu has taken all her jewellery, their cash savings and the passports. Virat calls all his family and friends but no one knows where Indu has gone. Virat comes to see you a few days later and instructs you to file an urgent ex parte application seeking to place Ahmed on the family law watch list....
