2 Mountain Top View Data Breach Report INTRODUCTION Ethics is “the process of reflection in which people’s decisions are shaped by their values, principles and purpose rather than unthinking habits, social conventions, or self-interest.” (PirieGriffiths, 2021). Laws are the rules and regulations set by authorities that govern how a society act. Laws and ethics are closely aligned because they both serve as guidelines to civilization while regulating how they can act. Corporate social responsibility, or CSR for short, is “perceived as situations where organizations undertake social initiatives in support of the communities within which they operate” (Kuna-Marszałek & Kłysik-Uryszek, 2020). Personally, I believe companies that engage in CSR are generally more profitable than those that don’t. This is because of their ability to retain their workforce as well as reduce any intrinsic risks. CSR and ethical business practices are related because of the shared benefits they bring to the business that applies them. They may: “1) attract customers to the company’s products, thereby boosting sales and profits; 2) encourage employees to adhere to the business, reducing labor turnover and therefore increasing productivity; 3) attract more employees to the business, thus enabling the company to hire the most skilled employees; and 4) attract investors and keep the company’s share price high, thereby protecting the business from takeover” (Merchant, 2013). ANALYSIS Due to the varied nature of laws across states, there is no guarantee a company would inform customers about a data breach and said company wouldn’t be doing anything unlawful. There are guidelines put in place by the Federal Trade Commission (FTC, for short) that state whenever a business experiences a data breach, they should “notify law enforcement, other affected businesses, and affected individuals” (Federal Trade Commission, 2021). However, the

3 Mountain Top View Data Breach Report actual enforcement is left to the state the data breach took place in. If any of the data involved in the breach involves electronic personal health records, it might be necessary to notify the FTC and, in some cases, the media. Many of the states require businesses to provide reasonable security measures to protect consumer’s personal data. This includes but is not limited to 1) credit card info, 2) social security numbers, 3) passwords, and lastly 4) first/last names. RECOMMENDATION AND CONCLUSION In the event of a breach, the business’ management should be the first notified. Afterwards, and depending on the type of breach, law enforcement, staff, customers and the general public should be notified as well. Choosing to keep a data breach in the dark can considerably hurt the business’ brand and can potentially lower profits. The more integrated a piece of technology becomes to the way we conduct business, the more potential ethical challenges we can encounter. In order to maintain an ethical workspace, ethical business practices should grow and evolve with technology. These advances in technology have both legal and ethical implications because making something that used to either be very costly or hard to attain more accessible via technology might make people act unethically in order to get it, and perhaps even break the law in the process.
