OIL AND GAS LAW – RESEARCH ASSIGNMENT 2019 ASSIGNMENT ASSESSMENT CRITERIA 1. Literature: Research and review a. Range and depth of research and reading b. Evidence of independent research related to the question (ie not just using the resources provided. NOTE: USE SCHOLARLY ARTICLES, not those found on Google search!!!) 2. Analysis and legal argument a. Critical analysis of legal issues and articulate an argument (don’t just describe) b. Formulate legal argument based on appropriate laws, legislation or cases 3. Conclusion a. Formulate conclusion based on critical analysis and arguments 4. Form Issues a. Presentation b. Grammar, expression and spelling, and appropriate and accurate use of language c. Appropriate and accurate referencing (use of AGLC4)

INSTRUCTIONS AND EXPECTATIONS This assignment is worth 50% of your final grade and the deadline for handing in the assignment is 12 noon on Friday, 17th January, 2020 Total Length is 3,000 words, excluding Bibliography and footnotes. When undertaking the research assignment ,the following is expected: 

Research - the materials provided on MOODLE are designed as introductory readings. This is a research assignment and therefore it is expected that quality research will be undertaken



The course has considered on a number of jurisdictions, not just Australia. Where appropriate, students are welcome to consider the experiences of international jurisdictions in their analysis.

RESEARCH QUESTIONS – Answer ONE research question ONLY 1. Critically analyse the following statement (note this is a fictional quote from a fictional person): The future of OPEC has never been bleaker. The USA is now the largest global oil and gas producer, thanks to the shale gas revolution. Saudi Arabia’s reserves are falling, and the government is selling off part of its jealously guarded state oil company, Saudi Aramco. Furthermore, Political unrest and war abounds in the Middle East. Furthermore, the role of petroleum in the world’s energy mix has dwindled. The rise of non-OPEC producers of gas, and the advent of renewable energy has ensured that OPEC is almost obsolete. In addition, the existing international legal framework for energy is out of date, and the role of the state is irrelevant. 2. To what extent does the law play a role in the exploration for and production of petroleum resources? In your answer you may consider examples from international law, as well as national law in a jurisdiction of your choice.

Considering the current interest in exploring for petroleum in the Great Australian Bight, is the current offshore petroleum regulatory framework in Commonwealth Waters adequate for preventing and responding to oil spills and for protecting marine reserves? 4. To what extent does the ‘water trigger’ provide environmental protection in shale gas activities? 5. To what extent can the regulation of health, safety and environment is Australia be categorized as global best practice?...
