Outline TheBayviewHotelGladesville(the“Hotel”)operatespursuanttothehotel licenceno.LIQH400100434 (the“Licence”)andissituated intheRydeCity LocalGovernmentArea(the“LGA”),which isclassified bytheIndependentLiquorandGaming Authority(“ILGA” andthe“Authority”)asBand2.TheHotel’s currentgamingmachinethresholdis29(“Threshold”). The Hotel’s licensee, Rodney Pittorino (the “Licensee” and the “Applicant”) lodges the enclosed thresholdincreaseapplication(the“Application”)seeking ILGA’s approvalforalow‐rangeincreaseof theThresholdto30,equatingtoathresholdincreaseof1. 2. OperationofHotel TheprimarypurposeoftheHotelisthesaleofliquorbyretail. However,theHotelalsohasasubstantialkitchen providingheartyclassicpubfoodandothercuisines andproudlyhostsliveentertainment,includinglivemusic. Approved gaming machines are operated in discrete internal and outdoor gaming rooms within the Hotel.GamingformsanimportantcomponenttotheHotel’svarietyofservicesandfacilities. 3. Localcommunity ConsistentwiththeAuthority’snormalproceduretheApplicantsubmits thatthelocalcommunity,for thepurposeoftheApplication,isthesuburbofGladesville(the“Suburb”). WhilesomecustomersattendtheHotelfromoutside theSuburb, themajorityof regular patronsare fromwithintheSuburborthenearbysuburbsofHuntersHillandPutney. 4. HarmMinimisation TheHoteltakesitsroleofprovidingapprovedgamingmachinestothe publicseriouslyandappliesthe harm minimisation provisions of the Gaming Machine Act (2001) (the “Act”) and Gaming Machine Regulations (2010) (the “Regulations”) carefully. Most importantly, the Hotel ensures that no minors gain access to the gaming room or use the approved gaming machines. Furthermore, the Hotel is consciousofandsensitivetotheissue ofproblemgambling,andbylodgingtheApplication, doesnot seektochangethefocusoftheHotelfromthatofasocialdestinationforthelocalcommunity. 5. Positivecontribution The Hotel is already an important contributor to and/or sponsor of the local community. If the Application is approved, the Hotel will provide financial assistance in the sum of $10,000.00 to the followingnot‐for‐profitorganisation:GiantSteps,Gladesville.

INTRODUCTION Pursuanttos34(1)oftheAct,theApplicantappliestotheAuthoritytoincreasetheThreshold. This local impact assessment (the “Assessment”) is required as, pursuant to s35(3)(b) of the Act, the HotelissituatedinaBand2LGAandtheapplicationisforalow‐rangeThresholdincrease(1). TheApplicantisawarethat,pursuanttos36(1)oftheAct, theApplicationcannotbeapprovedunless the Authority approves this local impact assessment, class 1 (the “Assessment”). Similarly, the Applicantacknowledges,pursuanttos36(3),thattheAuthoritymayapprovethisAssessmentonlyifitis satisfiedthatit: (a) complieswiththerequirementsofDivision1oftheActandtheRegulations; (b) demonstratesthatgamblingactivitieswillbeconductedinaresponsiblemanner; (c) demonstrates that the increase to the Threshold will provide a positive contribution towards thelocalcommunityoftheHotel;and (d) addressescommunityconcernsarisingoutoftheconsultationprocess. ItistheApplicant’scontentionthattheAuthoritywillbesatisfiedasto(a),(b)and(c)bythecontentof this Assessment and to (d) through such further actions the Applicant takes if and when community concernsareraised. The Applicant invites the Authority to ask further questions or make such further requisitions as it considersnecessaryinordertoallowtheApplicationtobeapproved. 2. THEHOTEL HistoryofHotel TheHotelhasoperatedfromthesamesitesince1958. SincetheOwnertookovertheHotelin1980,ithasundergonemajorrenovationsandrefurbishmentto modernise the building and provide patrons with a variety of areas to cater for differing tastes and requirements. StyleofHotel TheHotelisoneofthemostvibrantandfriendly establishments inSydney.Just20minutesfromthe SydneyCBD,ithaslongbeenapremierdiningandentertainmentdestination. The Hotel has multiple areas which it operates. There are 4 bars within the venue which service differentareasof theHotel. Two bars are operating at all timesto servicethegeneral bar area,gaming roomandTABcustomers.One baroperatesasa function roomandutilisedforthisserviceandthe4th baroperatesprimarilyduringbistroopeningtimesandpeakperiods. The Hotel has a significant food trade offering operating 7 days a week. The bistro has a full menu featuringwoodfiredpizzas,classicpubmeals,qualitychildren’smealsandrestaurantqualityfish,steak andpastamaincourses. Entertainment is provided approximately 5 nights a week and includes comedy, live bands and solo acts, trivia and karaoke along with televising sporting events. TheHotelhasabroadrangeofclients,most ofwho arelocals. Thebistroisparticularly popularwith familieswhilstadultstypicallybetween20and60yearsfrequenttheHotelintheevening. AnarrangementofrecentphotosoftheHotelareannexedandmarked“A”. FloorArea ThefloorspaceareaoftheHotel(excludingtheoutdoorareas)isapproximately836m2. A plan of the Hotel, which discloses the layout and shows the facilities provided within the Hotel, is annexedandmarked“B”. Staff The Hotel provides employment for approximately 50 staff across multiple roles including, bar staff, waiters, management, bottle shop and kitchens. On top of this the Hotel also contracts security and cleaningpersonnelforapproximately10people. Sponsorships,DonationsandCommunityContribution The Hotel supports the following local schools – Gladesville Public, Putney Public, St Charles Primary, Our Lady Queen of Peace Primary, Boronia Park Public, Villa Maria Primary and St Josephs College. ThroughdonationsandsupportTheHotel hasinvestedinover$15,000annuallytohelptheseschools infundraising.Thisisviagiftvouchers,prizes,roomhire,freeeventequipment(glasses,table,tubsand ice)andstaffsupport. TheHotelhassupportedHuntersHillCouncileventsintheGladesvillearea.Thesehaveincludedalocal streetmovienightandstreetfoodfestival. The Hotel hosts regular music workshops in conjunction with the Gladesville Guitar factory with proceedsgoingtoMSSociety. TheHotelalsosupportsnumeroussportinggroupswithinthelocalarea–RydeSwimmingClub,Hunters HillRugby, GladesvilleravensSportsClub,PutneyRangersFootball Club,RydeHunters Hill CricketClub and Ryde Eastwood Touch Football. The total contribution to these sporting clubs is approximately $50,000annually TheHotelhasbeenhostinglivemusicforover30years and currentlysupportsthelivemusicindustry byprovidingfreemusic(includingoriginalacts)3nightsperweek. 3. COMPLIANCEWITHACTANDREGULATIONS As a diligent hotelier, the Applicant takes seriously its responsibilities to comply with the Act, the RegulationsandtheLiquorAct. PlanofManagement The Hotel operates in accordance with its Plan of Management, a copy of which can be provided on request. The Hotel will continue to implement its Plan of Management and responsible gaming practicesiftheAuthorityapprovesthisApplication. Minors Minorsareonlypermittedonthepremiseswhenaccompaniedbyalegalguardianandcan only enter signpostedauthorisedareasofthevenue.MinorsarestrictlynotpermittedintheGamingRoom. PHAPS‐HOT_170112_005.docx

Responsiblegamblingandharmminimisation The primary purpose of the Hotel is the sale of liquor by retail. As described above, the Hotel also aims at making its food a reason for patrons to visit the Hotel. Gaming machines are operatedindiscreteinternalandoutdoorgamingrooms.
TheHotelappealstothediverseRydeLGAcommunityincludingresidentsandbusinesspersons.
In addition to the mandatory legislative requirements, the Hotel implements the AHA’s GameCareself‐exclusionprogram.
TheLicenseeisamemberoftheLocalLiquorAccord.
CompliancewiththeActandRegulations TheHotelanditsemployeesare consciousof obligationsundertheActandRegulationsinrelationto gaming,including: TheHoteldoesnotdisplayanygamblingrelatedsigns, includingadvertisementsaboutapproved gamingmachines,anywhereoutsideorinthevicinity oftheHotelnoranywhereinsidethe Hotel sothatitcanbeseenfromoutsidetheHotel. Thegamingroomislocatedbothinternallyandwithanoutdoorgamingareaandhasnoopenor see‐throughwindowsordoorsfrontingthestreetthatwouldmakeitvisiblefromthestreetsoas toenticethepublicintothegamingroom.
TheHotelhas nocashdispensingfacilityon itspremiseswhichpermitscashto beprovidedfrom a credit card account, the Licensee does not permit an ATM or EFTPOS terminal in the gaming roomandoneachATMdisplaysa“Think!Aboutyourchoices”notice.
The Hotel ensures its patrons have access to a self‐exclusion scheme and publicises the availabilityof self‐exclusionschemesandinformationabouthowthey operatetoitspatronsand theLicenseemakesavailableatalltimestopatronsof theHotelinformationasto thename and contactdetailsoftheproblemgamblingcounsellingservice madeavailablebyorthroughNSW AustralianHotelAssociationviatheirGameCareprogrammeandtheLicenseedisplaysanoticein thegamingroomprovidingtherelevantdetails.
Personsundertheageof18yearsareprohibitedfrombeingin thegamingroomandoperating approvedgamingmachinesattheHotel.
Thegamingroom islocated inabarareaoftheHotel and isnotinapartoftheHotel in respect ofwhichaminorsareaauthorisation oraminorsfunctionsauthorisationis inforce,patronsare not be compelled to pass through the gaming room in order to enter or leave the Hotel or in ordertogain access toanotherpartoftheHotel,entry to the gaming roomis provided free of charge,thegamingmachinesin thegamingroomaresituatedsothattheycannot be seen from anyplaceoutsidetheHotelthatisusedbythepublicor towhichthepublic hasaccess andthe gamingroomisatalltimessupervisedbytheLicenseeor anemployeeoftheLicenseebyway of electronicmeansorphysicalpresence,orboth.
The Hotel displays notices providing information about the chances of winning a major prize, makes available in the gaming room in conspicuous places to patrons of a compliant player information brochure approved by the Authority and makes available on request a community languageplayerinformationbrochureinArabic,Chinese,Korean,TurkishorVietnamese.
The Hotel displays on each approved gaming machine in the gaming room a gambling warning noticeandaproblemgamblingnoticeinaconspicuousplace.
TheHoteldisplaysaThink!Aboutyourchoices notice inthevicinityof themainentranceto the Hotelinaconspicuousposition.

The Hotel has a clock in good working order and that is set to, or within 10 minutes of, the correcttimeinthegamingroomina conspicuousposition soitcanbeseenfromallpartsof the gamingroom.
TheLicenseepays anyprizemoneyin excessof $5,000or,ifrequestedbytheperson,allprize moneyifinexcessof$5,000, byeithercrossed payable totheperson or by means of electronic fundstransfertoanaccountnominatedbytheperson.
TheHoteldoesnotofferorprovideapromotionalprizethatisindecentoroffensiveinrelationto apromotioninvolvinggamingmachines.
TheLicenseedisplays gamblingcontactcards ina cardholderthataresecurelyattachedtoeach bankofgamingmachinesinthegaminggroominaconspicuouspositionsothatapersonplaying agamingmachineorapproachingthebankofgamingmachineswouldbeabletoseeit.
TheLicenseedoesnotofferorsupply, or causeorpermittobeoffered orsupplied, anyfreeor discountedliquorasaninducementtoplayapprovedgamingmachinesintheHotel,orofferfree creditstooroffer orprovide, orcause orpermit tobeofferedorprovided,as an inducement to playgamingmachinesintheHotel,anyprizeorfreegive‐awaythatisindecentoroffensive.
TheLicenseeensuresthatheandallpersonsemployedatthe Hotelwhoseduties areconcerned in the conduct of activities involving gaming machines in the Hotel have their recognised competency cards, which are available for inspection by a police officer or an authorised inspector.
The Licensee keeps a register containing a copy of all current existing RCG certificate for any person whosedutiesareconcernedintheconductofactivitiesinvolvinggamingmachinesinthe Hotel and makes the register available for inspection on request by a police officer or special inspector.
4. LOCALCOMMUNITY Area TheHotelislocatedintheSuburb.TheSuburbfallswithintheLGA. ForthepurposeofthisAssessment,theSuburbisthelocalcommunity. RydeLGA TheLGAislocated inSydney'snorth‐westernsuburbs,about10kilometresfromtheSydneyGPO. The LGA is bounded by Hornsby Shire and the Ku‐ring‐gai Council area in the north, Willoughby City, the LaneCoveRiverandtheHuntersHillMunicipalityintheeast,theParramattaRiverinthesouthandthe CityofParramattainthewest. TheLGAcovers40km2.Asat2016,theLGAhadanestimatedpopulationof119,544 GladesvilleSuburb TheSuburbhasapopulationof10,974andissituatedinthesouthernpartoftheLGA. ImpactonLocalCommunity TheHotelpresentlyoperateswiththeThreshold.TheHotelisaware thatproblem gambling is an issue andcanheavilyimpactonaperson’slife andfamily,althoughtheHotel itselfhasnotexperienced any specificissues.TheApplicationisseekingthesmallestpossibleincrease(of1),andsubmitsthatifthere isanyimpact,itwillbecorrespondinglyminor. DonationtoGiantSteps TheApplicanthasidentifiedthenot‐for‐profitorganisationGiantStepsSydneyPtyLtdof“StepHouse”, 23PuntRoadGladesvilleasbeingavaluablecontributortothelocalcommunityinsupportofchildren withautism.IntheeventtheApplicationisapproved,theApplicantwillmakea$10,000.00donationto GiantSteps. GiantStepsseekstodevelopintensivetherapeuticandeducationalprogramstoensurethateachchild hastheopportunitytoreachtheirfullpotential. GiantStepsSydneyalsoseekstoprovidesupporttofamilies,toimproveunderstandingofautisminthe widercommunityandtodevelopbestpracticeamongcarersandprofessionals.Itsvisionistocontinue toberecognisedasacentreofexcellenceforthecreation,implementationanddisseminationof innovativeandeffectiveprogramsandservicesforchildrenwithautismandtheirfamilies. CONCLUSION The Applicant submits that the Application should be approved by the Authority in full because the AuthoritywillbesatisfiedontheinformationcontainedinthisAssessmentthat: (a) theApplicationcomplieswiththerequirementsoftheActandtheRegulations; (b) gamblingactivitiesattheHotel willbe conductedinaresponsiblemanner having regardtothe harmminimisationmeasuretobeundertaken;and (c) theAssessmentidentifiesthelocalcommunity(andthesocio‐economicstatusofthepopulation) and demonstrates how a positive contribution will be made to the Suburb if the Application is approved.
