Assessment Task 1: Written questions

You must correctly answer all questions in this task to show that you understand the knowledge required of this unit.

Assessment Task 2: Enterprise agreements project

You must provide information about a company’s Enterprise Agreement to staff.

Assessment Task 3: Managing disputes project

You must manage a workplace dispute.

Assessment Task 4: Enhance industrial relations project

You must develop a survey that can be used to monitor the implementation of industrial relations policies and procedures and the workplace climate.

How to submit your assessments When you have completed each assessment task you will need to submit it to your assessor. Instructions about submission can be found at the beginning of each assessment task. Make sure you photocopy your written activities before you submit them – your assessor will put the documents you submit into your student file. These will not be returned to you.

STUDENT INSTRUCTIONS FOR TASK 2 Carefully read the following: Follow the link below, and select an Enterprise Agreement for a company of your choice, registered no earlier than 2015: https://www.fwc.gov.au/awards-and-agreements/agreements In this Assessment Task you are required, in the role of Human Resources Officer, to provide information to staff about the new Enterprise Agreement that you have selected. The company’s organisational procedures state that when a new Enterprise Agreement has been entered into, all staff must receive training that outlines the purpose and benefits of the agreement. Staff are to be given ample opportunity to ask questions about the new agreement and how it applies to them. Complete the following activities: 1. Create a PowerPoint presentation Review your selected Enterprise Agreement and prepare a presentation that address all of the following: 

A brief overview of the key legislation covering employment term and conditions.



An outline of the purpose and benefits of enterprise agreements, and the differences between an Enterprise Agreement and a Modern Award.



To whom the agreement applies and the date and period of operation



A summary of key terms and conditions as specified in the agreement, including weekly hours, wage rates, flexible working arrangements, leave arrangements, termination and redundancy information.

To ensure that staff can easily understand the information, your presentation must include plain English and visuals or charts to increase interest and engagement. Assessment Task 3: Managing disputes project TASK SUMMARY In this assessment task, you are required to assist in minimising industrial relations conflicts by providing advice to management about how to respond to an industrial relations issue, and working with employees to resolve their issues.

STUDENT INSTRUCTIONS FOR TASK 3 Carefully review the following: Marion is employed part-time as a Sales Representative with Cherry Enterprises, a metal fabrication company which also specialise in laser-cutting services. The company employs approximately 25 staff, 5 of whom are Sales Representatives. Jason, another Sales Representative, joined the company one month prior to Marion, and is working fulltime. In conversation with Jason, Marion learns that Jason’s full-time salary is $52,000 per annum plus superannuation. When she works out her part-time salary in relation to Jason’s full-time salary, and realises that, if she were working full-time, she would not be earning the same salary as Jason. Marion’s rate, calculated on a full-time basis comes to $47,000 per year. Marion believes that she has the same level of experience and skills as Jason, as she worked in sales for 10 years prior to leaving the workforce to have children. The company does not have an enterprise agreement. All employees are employed based on a contract between the company and the employee. The contract reflects minimum conditions as set out in the National Employment Standards. The Human Resources Manager has discussed the matter with the CEO. Jason has worked in the metal fabrication industry as a sales representative previously, and also has highly specialised knowledge of laser cutting techniques. It is on this basis that Jason is paid more than Marion, as he has to deal with both general customers, as well as customers who require specialised laser cutting services. The CEO believes that the situation needs to be handled carefully, as it could lead to a conflict within the organisation about gender equity in pay. He asks the Human Resources Manager to conduct a meeting with Marion to discuss the issue. In order to assist the Human Resources Manager to conduct the meeting, they have asked you, the Human Resources Officer, to conduct some research and prepare a report for discussion prior to meeting with Marion to discuss the situation. When you have completed your research, develop a short briefing report for the Human Resources Manager and CEO on your research. Include an outline of the situation and key facts. Also give your recommendations on how to approach the workplace situation, including the required outcomes and the strategy that you will use at the meeting to deal with the potential/actual industrial relations conflict. 2. Send an email to the Human Resources Manager and CEO (your assessor). The text of the email should be in grammatically correct English, written in an appropriate (polite, businesslike) style. It should introduce and summarise the contents of the attachment, and seek their feedback. Attach your gender equity in pay report to the email. 3. Meet with Marion (your assessor). Prior to the meeting, you should practice what you are going to say to Marion, including confirming the situation and outlining the company’s response. You should be clear and direct, and thoroughly explain the company’s decision, including why Jason is paid more. You should anticipate that Marion is likely to be upset and be able to calmly counter any arguments that Marion raises in regard to whether your actions is lawful. You should explain the legislative position that you identified through your research.
