8. Course Synopsis:

This course aims to concentrate on the analysis of the law governing trusts in Malaysia. Basically Malaysian law of trust is a product of English law of trust. The course will therefore incorporate principles and examine how these legal principles have been imported or modified to form the corpus of the law relating to the creation of trusts, various types of trust, namely express trust, resulting trust, constructive trust and charitable trust; the appointment, retirement and removal of trustees, their duties, breach of trust and remedies. The Islamic input will focus on the concept of waqf as compared to the charitable trust.
