Emergency Psychiatric Detention Use of Mental Health Act (Care and Treatment) (Scotland) 2003   

Can treat psych emergencies under Common Law Police can bring person to ‘place of safety’ Emergency Detention Certificate: o 72 hours, any registered doctor o Allows emergency assessment + treatment o Best to gain consent of MHO, but not necessary if time not permitting

Emergency Detention Criteria (EDC)    

Presence of symptoms of mental illness Significantly impaired decision-making ability (SIDMA) Significant risk to self/others Unable to be treated on informal basis – detention necessary (least restrictive option)

Short-Term Detention Certificate (STDC)   

Better than EDC if possible 28 days assessment/treatment of mental disorder Need Approved Medical Practitioner + MHO

Compulsory Treatment Order (CTO)   

Ca be hospital/community based 6 months initially Can be discharged under a suspension...
