ASSENT OF THE CHANCELLOR These statutes have received the assent of the Chancellor communicated in Lr.No.589/U2/2012, dated 24.08.2012 of the Secretary to the Governor of Tamil Nadu.

The Tamil Nadu Dr. M.G.R. Medical University (Affiliation of Naturopathy and Yoga Medical College Statutes) (BNYS) In exercise of the powers conferred by Section 42 of the Tamil Nadu Dr. M.G.R. Medical University, Chennai, Act, 1987 (Tamil Nadu Act 37 of 1987), and in supersession of the statutes for Affiliation of Naturopathy and Yoga Medical College (BNYS), the Governing Council of the Tamil Nadu Dr. M.G.R. Medical University, Chennai, hereby makes the following Statues:-

1.

(i) These statutes may be called the Tamil Nadu Dr. M.G.R. Medical University (Affiliation of Naturopathy and Yoga Medical College Statutes (BNYS)). (ii) They shall come into force from the date of assent of the Chancellor.

2. The words and phrases used in these statutes shall unless expressly explained otherwise, have the same meaning as they have with reference to the Tamil Nadu Dr. M.G.R. Medical University, Chennai, Act, 1987 (Tamil Nadu Act 37 of 1987) hereinafter called “the Act”.

3. It shall be necessary for the proposed Naturopathy and Yoga Medical College seeking Provisional Affiliation to the Tamil Nadu Dr. M.G.R. Medical University, for starting First Batch of Bachelor of Naturopathy and Yogic Sciences Degree course, to apply for “Letter of Consent of Affiliation” of its application with the Tamil Nadu Dr. M.G.R. Medical University, Chennai.

4. (i)

Only Educational Trust / Society (hereinafter referred to as “applicant”)

with sufficient financial

soundness and which satisfy

the conditions stipulated

hereunder in sub-statute (ii) shall be eligible for starting a Naturopathy and Yoga

Affiliation”

will not be entertained. (ii)

Conditions to be satisfied by the applicant for issue of “Letter of Consent of

Affiliation”: (a) “The applicant college shall be in possession of Naturopathy hospital being run by it with not less than 50 beds with an administrative block. (b) The hospital and administrative block are to have been located in an area of 5 acres, if the college is to be started in a Corporation area or 7 acres in Municipal area and 10 acres in other areas.

The application for “Letter of Consent of Affiliation”

from the Tamil Nadu

Dr. M.G.R. Medical University, Chennai, shall be in writing and in Form I annexed with these statutes addressed to the Registrar of the Tamil Nadu Dr. M.G.R. Medical University, Chennai and shall be submitted to the Registrar between 1st July and 31st October of every year. 6. (1) The application for “Letter of Consent of Affiliation” shall be submitted along with the permission of the Government of Tamil Nadu to establish the college and contain the following particulars, namely:(a)

Name of the Educational Trust / Society with full address

(b)

Name of the proposed Naturopathy and Yoga Medical College.

(c)

Address where the Naturopathy and Yoga Medical College is to be located with telephone No, Web, Email, etc.

(d)

Details regarding the administrative block of the hospital and its location.

(e)

Details of the hospital with plan(approved by the competent authority), owned by the Trust / Society such as;(i)

The staff working in hospital and college.

(ii)

Number of out-patient sections, { example Male, Female, Ortho, Cardiac, Diabetic, Children, Maternity, Endocrinology, Obesity, etc. }

(iii)

Daily out-patients turn over, { average }

(iv)

Bed occupancy, { average per month and year }

5 (v)

Master plan for the development of the Hospital as a future teaching hospital with strength of 100 beds with all necessary facilities.

(vi)

Facilities like Herbal garden, green grass bare foot walking track, pebble walk track,

workshop, laundry, canteen, auditorium,

swimming pool { Water therapy} etc. (vii)

Location & details of hostels for men and women, separately;

(viii)

Location & particulars of play ground,

(ix)

Staff quarters proposed,

f)

Particulars as to the availability of Land, Building, other physical infrastructure etc.

g)

Number of students proposed to be admitted in the first batch of the Bachelor of Naturopathy and Yogic Science Degree course.

h)

Particulars as to the availability of training facility for the students to be admitted in the college:

i)

Particulars as to the availability of ready built area for the accommodations of the academic complex and residential quarters for the staff of the proposed college.

j)

Inspection Proforma duly filled-in pertaining to issue of Letter of Consent of Affiliation;

(k) Total population of the area in and around 20 kms of radius of the area in which the Naturopathy and Yoga Medical College is to be located. (l) Availability of water supply, transport facilities, development potential etc. (m) Details regarding the financial soundness of the Trust / Society with supporting documents to show that it has the capacity to deposit Rs. 10,00,000/-(Rupees ten lakhs only) in three phases as under:(i)

Rs.4,00,000/- (Rupees four lakhs only) at the time of Provisional Affiliation for first batch of Bachelor of Naturopathy and Yogic Science Degree course.

Rs.3,00,000/- (Rupees three lakhs only) at the time of Continuance of Provisional Affiliation for Second Batch of Bachelor of Naturopathy and Yogic Science Degree course.

(iii)

Rs.3,00,000/- (Rupees three lakhs only) at the time of Continuance of Provisional Affiliation for third batch of Bachelor of Naturopathy and Yogic Science Degree course.

(2)

The applicant shall also furnish proof to show that the Trust has an

annual receipt of Rs.50,00,000/-(Rupees fifty lakhs only) excluding interest

drawn

from

the

amount

referred

to

in clause

the

(m) of

sub-statute (i)above. (3)

The applicant shall also enclose a payment receipt for processing fee of

Rs.50,000/- (Rupees fifty thousand only), Inspection fee for Rs.40,000/(Rupees forty thousand only) and cost of application for Rs.1,000/- (Rupees one

thousand only) or such amount as may

be

prescribed

by the

Governing Council from time to time. 7.

On receipt of the application for the “Letter of Consent of Affiliation” of the

University shall scrutinise the same and verify by deputing an Inspection Commission whether the conditions required to be fulfilled by the applicant to become eligible to receive the said “Letter of Consent of Affiliation” are fulfilled. 8.

The Inspection Commission shall specifically examine whether the following

conditions are fulfilled by the applicant and duly verifying the Inspection Proforma submitted by the Management and make a detailed report to the University:(a) The applicant shall possess and own land of an extent of 5 (five) if the hospital and administrative block are to be located in a Corporation area (or) 7 (seven) acres if it is to be located in a Municipal area or 10 (ten) acres if its is located in other area. (b) The applicant shall fulfill necessary provisions of relevant Acts on the subject such as Tamil Nadu Town and Country Planning Act, 1971 (Tamil Nadu Act 35 of 1972) and Tamil Nadu Land Reforms (Fixation of Ceiling on Land) Act, 1961 (Tamil Nadu Act 58 of 1961) or other

7 local body Acts as in force and shall also ensure the evidence so produced in this regard is valid and relating to the applicant. (c) The applicant shall also satisfy that they have actual physical possession of the lands and shall furnish necessary documents in this regard and such other documents required by the University from time to time. (d) The applicant shall satisfy the University that all the infrastructural facilities of the college are made available in one campus. (e) The applicant shall run Naturopathy hospital (located in the above land) of not less than 50 beds with out-patients sections. There must be good out-patients turnover minimum 50 per day and 50% bed occupancy. The hospital shall have its own Full time administrative staff.

The applicant trust shall have a master plan of the future

teaching hospital with bed strength of 100 with all other required facilities including specialities. The facilities like Herbal garden , green grass bare foot walking track, pebble walk track,

swimming pool

{Water therapy} workshop, laundry, canteen, auditorium, location of hostels separately for men and women, availability of play ground, proposed staff quarters, etc., and these facilities shall be made available in total or in phased programme. (f) The inspection Commission shall examine and satisfy itself with the facilities and performance of the existing hospital, the master plan for future developments and financial viability of the applicant in relation to the movable and immovable properties, the bank balance, interest accrued on the same and its capability to deposit a sum of Rs.10,00,000/-(Rupees ten lakhs only) in a Nationalised Bank or Tamil Nadu Government Undertaking / Corporation which accepts fixed deposit in three phase of Rs.4,00,000/-(Rupees four laksh only, Rs.3,00,000/- (Rupees three lakhs only) and Rs.3,00,000/- (Rupees three lakhs only) for the Bachelor of Naturopathy and Yogic Sciences Degree course. Further the applicant must be in a sound financial position so as to have annual receipt of not less than Rs.50,00,000/(Rupees fifty lakhs only) excluding the interest accrued from the aforesaid deposit.

The University if fully satisfied on the basis of the report of the Inspection

Commission that all the conditions required to be fulfilled by the applicant are fulfilled shall issue a “Letter of Consent of Affiliation” in Form II annexed with these statutes, on production of a payment receipt for Rs.50,000/- (Rupees fifty thousand only) towards fee for issue of Letter of Consent of Affiliation, to the applicant to enable the applicant to make further arrangements to start the First Batch of Bachelor of Naturopathy and Yogic Sciences Degree course in the proposed Naturopathy and Yoga Medical college. 10.

The issue of the “Letter of Consent of Affiliation” alone shall not confer any

right on the applicant to start the Bachelor of Naturopathy and Yogic Science Degree course. 11.

The applicant on receipt of “Letter of Consent of Affiliation”

from the

University, shall apply to the University for Provisional Affiliation of First Batch of Bachelor of Naturopathy and Yogic Science Degree course in Form III annexed with these statutes and shall fulfil the conditions stipulated in statutes 12 to enable the University to appoint and send an Inspection Commission to the proposed Naturopathy and Yoga Medical college. 12.

The applicant shall, before applying for Provisional Affiliation for the Bachelor

of Naturopathy and Yogic Science Degree course fulfil the following conditions namely:(a)

The Naturopathy hospital run by the Trust / Society shall be well

organized with 50 beds: and with separate outpatients sections and with such other facilities as detailed below:

There shall, be a minimum of 1:1 students and patient ratio in the First Batch of and it should be upgraded to 1:2 by the Second Batch of with the following facilities: 1. Diet Centre to cater to the Diet Therapy; Minimum 50 chairs and dining table or wooden long bench on the floor to accommodate patients 2. One single Yoga Hall to accommodate atleast 50 persons with a minimum space of 1800 Sq. ft. i.e. 36’ x 50’ = 1800 Sq. ft. with compulsory cross ventilation {sufficient

9 Windows} It should should be sound proof. With all Yoga practices framed Charts, Slokas etc. 3. Separate treatment sections for men and women consisting of Hydrotherapy equipments like Hip Bath Spinal bath, Spray Spinal Tub. Steambath cabin, Arm and foot bath , heat bath, special bath, head bath, aroma bath, immersion bath tub with Hot water tap, jet bath, enema room , and massage rooms and on the terrace with the parapet walls for mud bath and sun bath with cold water Shower area. 4. 10 massage rooms with cushioned massage wooden tables, size of 6 ½ x 3 ½ , not more than 2 tables in a room, 5. There shall be heads of departments and skeleton staff for the above

departments appointed six months in advance so that the departments are organized at the time of applying for Provisional Affiliation.

10 (c) There shall be a Principal-cum-Professor with an organized administrative office. The qualification for the post of Principal shall be as follows:(i) 4 years regular Diploma in Naturopathy from the board of Indian Medicine, Andhra Pradesh or 4 plus 6 months internship i.e 4 ½ yrs, regular N.D. of Osmania University , or B.N.Y.S; regular degree course from any recognized university with minimum of 10 yrs teaching experience & they should have done medical registration from the Tamil nadu board of Indian Medicine, Govt.of Tamil nadu.

Any Master Degree with first or second class with one year Diploma in Yoga Therapy from the recognised Reputed Yoga Institution with 10 years professional experience in Yoga & Naturopathy.

(d) There shall be hostel facilities for the students within the campus (e) Library: There shall be a library with cupboards and furniture for sitting and reading with not less than 2000 (two thousand) books and 20 journals. (f)

Staff Seminar Hall: There shall be a hall sufficiently big with necessary furniture for the conduct of Seminar and staff meeting minimum area of 1000 sq.ft with all electronic teaching aids.

(g) There shall be separate rooms with all required comfortable furniture for the following categories of staff as Indicated against each:

a) Professor’s room

- 1 (Minimum 150 sq. ft)

b) Associate Professor’s

d) Tutors’ / Lectures’ room

e) Room for other technical staff

At the time of inspection atleast 90 percent of teaching staff shall be present and the posting orders and acceptance of all other staff members shall be available. Original certificates of all the faculties should be available during inspection. All the section in the department namely, Anatomy, Physiology and Bio-chemistry shall be fully furnished with necessary equipments to enable proper teaching and training of the students.

The applicant after fulfilling the conditions stipulated in statutes 12 above shall

intimate the fact to the University along with a payment receipt for Rs.40,000/(Rupees forty thousand only) or such amount may be prescribed by the Governing Council from time to time towards the inspection fee payable to the University and shall request the University to depute its inspection commission.

14.

On receipt of the above intimation the University shall send its Inspection

Commission to inspect the facilities available at the proposed Naturopathy and Yoga Medical college with reference to the Inspection Proforma submitted by the Management and to submit report to the University as to the satisfactory fulfillment of the conditions required to be fulfilled. The Inspection Commission shall also report the lacunae, if any, in the fulfillment of any of the conditions required to be fulfilled and also advise as to the capability of the applicant to rectify the lacunae within a period

of

(thirty)

days

from

the

date

of receipt of the

University

communication/letter. In case there are lacunae in the fulfillment of the conditions, the University may conduct re-inspection wherever necessary on production of a payment receipt for Rs.40,000/- (Rupees forty thousand only) or such amount as may be prescribed by the Governin...
