TWO SIDED PENNY: Pros and Cons of Digital Privacy Act of 2012 Based on several statistics, it was unveiled that the social media and Internet penetration rate in the Philippines stood at 67%, the highest among Southeast Asian nations. Considering that Filipinos spend an average of 10 hours and 2 minutes each day online, vast quantities of personal information from the country, including photos of daily activities, are freely circulating the Web. Despite having numerous opportunities offered by these technological advancements in terms of information via the Internet, it is undeniable that there are still challenges and risks bound with it. Thousands of crimes are committed every single minute. Globally, unauthorized access to private data through the Internet has raised concerns amongst enterprises, citizens, and legislators. This issue is quite alarming, hence, there is a strong call to have such legislation as an avenue for precautionary actions as a means of data safety for Internet users.

From this, various jurisdictions have taken multiple approaches and strategies ranging from controlling access via data security legislation to deeming liability based on the nature of the data, such as through privacy regime. Locally in the Philippines, to ensure privacy and data protection of its users, the Philippine government passed Republic Act No. 10173 or the Data Privacy Act of 2012 (DPA), way back August 15, 2012.

This

law intends to protect personal information in information and

communications systems in the government and the private sector. This law protects the fundamental human right of privacy of communication while ensuring the free flow of information to promote innovation and growth from different standpoints. With most of the information nowadays being processed online, there is no doubt that the Data Privacy Act compliance is now a necessity in our daily actions. Positively, the implementation of Data Privacy legislation can be advantageous as it intends the protection of the citizens and highly concerns the privacy of the individual. It is just rational to have consent on various information being accumulated so that citizens have control over their personal data, and no such sensitive information

is forcibly taken on a certain Internet consumer. Netizens, citizens who utilize the Net or Internet, will be at ease acknowledging that there is a law and committee that safeguards them to combat the increasing threat of personal information, and processes with such legal authority.

More so, in terms of Business Integration, the DPA renders Customer Security as it protects valuable information such as business transactions and financial statements. DPA regulates the registration of such businesses that means they are issued with a data protection registration. Enterprises that abide by this law will instill confidence in the minds of their customers. It increases faith in consumers to purchase items or things online. Hence, They will know that any data they provided will be handled properly and in good reliance – making them more enthusiastic to share their personal information, whether it is credit card details or simply their phone numbers. If businesses are legally compelled to comply with data privacy and cyber-security legislation, obligatory training and technological improvements will prevent security breaches and data leaks, making businesses and their consumers safer. Subsequently, the Data Privacy Act can be a protection against cybercrimes and similar issues. As your data are safe and secured, it can avoid such illegal actions like Identity Theft or the deliberate usage of someone else's identity, usually to perpetrate crimes by taking financial or personal information of others in order to feign that individual's status to make trades or transactions. DPA can also safeguard our Human Rights / Civil Liberties as privacy enactment can restrict government and law enforcement agencies from easily obtaining private citizens' data to utilize in unwarranted invasions (hence, the obligation for a warrant before collecting personal data), especially that other 'authorities use this information for scamming innocent people.

However, looking on the other side of the coin, the Data protection legislations are far from being a perfect schema for protecting privacy in a digital age. Looking on the other side of the coin, the Data Privacy Act can also bear some disadvantages. For

businesses that constantly require their users' personal data to accomplish transactions, the price Of being compliant with the law can be a little bit of a problem. To keep being docile with data protection and privacy legislation, companies have to invest in compliance training, installing modern data management technology, and probably hiring extra manpower and evaluators, incurring expenses they did not have before....
