INCIDENTAL POWER Test of proportionality law must fall within the incidental aspect of a legislative power, asking whether the law constituted a reasonably appropriate method of furthering the subject matter contained in the core of the power. the effect of the laws will be valid as long as they bear some rational connection to the power EXPRESS S 51 (xxxix) – express incidental power confers on Parliament an express power to legislate with respect to ‘matters incidental to the execution of any power vested by this Constitution in the Parliament’
