Question Why constitution? Answer A constitution can be described as a simple document having a special legal sanctity which sets out the framework and the principal functions of the organs of government within the state, declares the principles by which those organs must operate and the relationship between the citizens and the organs of government1. The Interpretation Act2 section 4 define the Constitution United Republic of Tanzania3 , does not define the term constitution and the same extends to the interpretation of laws Act. A meaning of constitution is found under section 3 of the Constitutional Review Act4 which state that “constitution means the fundamental law, written or unwritten, that establishes the character of a state by defining the basic principles to which a society shall conform, distribution of powers and functions among pillars of the state, by describing the organization of the executive, legislature and judiciary, their regulation, distribution, and the limitation of different state organs, and by prescribing the extent and manner of the exercise of its sovereign power” Constitution is the among of the very important law in the state or country, the following below are the reason why have any state or country have the constitution which are Constitution is protect all fundamental rights of the citizens, this means that it show all rights and duties which must be protect in state or country in order to make citizen to live in the peacefully way. Illustration in Tanzania under Article 12 up to article 29 of The Constitution United Republic of Tanzania5 provide the rights and duties of citizen by follow the among of the constitution principle knows bill of rights. Constitution is to lay out the basic structure of the government according to which the people are to be governed .It is the constitution of country, which establishes the three main organs of the government, namely, the legislature, executive and judiciary. The constitution of country not only defines the power allotted to each of the three main organs, but it also significantly makes a clear demarcation of the responsibilities assigned to each of them, also the constitution does not simply provide a recipe for an efficient government, but also deals with limitation on power. Since power corrupts and absolute power corrupts absolutely, a constitution is established to restrict the abuse of power by those who conduct government function. Constitution of Republic of Tanzania6 under Article 4 shows the power of the organs shown above. The constitution of any country stands as the superior to all the laws framed within the territorial precincts of the country, this means that all law enacted in the country must follow the principle in the constitution ,if that law enacted and does not follow the constitution shall be null and void. Illustration under 64 (5) of Constitution of Republic of Tanzania7 prove that any must follow the constitution if that law does not follow the principles shall be null and void. The constitutions show the territorial of the state or country, this means that in the constitution have the Article shows the territorial of the state. Illustration in the Constitution of Republic of Tanzania8 under Article 2 show territorial of the Tanzania. The constitution is the law which talk about the structure of the all leaders in the country or state and there power and limitation of those powers. All above are the reason why constitution, this means every county or state must have it own constitution in order to make the citizen to live in peacefully way also to make leaders too works within the law.
