(11.05.2001) A conveyance of the land in this title dated 5th August 1888 made between (1) The Durham Estates Company Ltd (1) Henry Hay (2) contained the following covenants: The Purchaser hereby covenants with the Vendor and their successors and assigns that he will at all times observe and perform the following covenants:No part of the ground hereby conveyed nor any building erected or to be erected thereon shall without the previous written consent of the Vendor be used for the trade or business of a licensed victualler or for the sale of wine malt liquor or spirituous liquors or for the purpose of any profession business trade or manufacture whatsoever or for the purpose of keeping poultry or pigeons or in any manner from which any nuisance or annoyance can arise to the neighbourhood or otherwise than as a private dwellinghouse in the occupation of only one family at a time or be let or occupied in separate parts and in the case of the breach of the whole or any part of the stipulations contained in this clause the Vendors shall be entitled to recover and receive from the purchaser his heirs executors administrators and assigns as and for liquidated damages agreed between the parties the sum of twenty pounds for each month or part of a month during which such stipulations or any part thereof shall be broken or infringed.
