1. What is the relevance of Human Rights in the debate surrounding assisted dying? Discuss with reference to legislation, case law and academic commentary. 2. The law is clear on the legal status of the foetus. Critically discuss the above statement with a particular focus on ethics. 3. Ali was born into a devout Muslim family. Ali is close to his family and loves them dearly. Ali is not religious at all. Ali tells his close circle of friends that he hopes that his body can be used for research after his death. Ali dies in an unfortunate and unexpected accident. Ali’s family now want to bury his body and observe all of the burial rituals in Islam. They are distraught and devastated at the possibility that they may not be able to do that according to what Ali’s friends have now told them. Ali’s family say that Ali would have not have wanted to cause his family any further pain. As time is of the essence Ali’s family have now turned to you for legal advice. What should be done to Ali’s body now that he is dead? Give full reasons for your advice. 4. Simon Powell is a rich music producer who is normally surrounded by a team of personal assistants. Due to a medical emergency Simon Powell has been admitted to a local NHS hospital and pending tests he is not allowed to have his team of personal assistants visit. Simon Powell needs to give his consent for a procedure which he needs urgently. He has heard a number of phrases and words around him by doctors and nurses alike and he does not understand them. He calls you, his lawyer, to clarify the meaning of these terms. a) What is the ‘doctrine of informed consent’? b) What is the ‘best interest principle’? c) What is the ‘right not to know’? Although Simon Powell is rich, in fact he is not very bright at all. It would be helpful if you could explain these terms to him in light of current law and case-law including examples to aid his understanding.
