Description

 Micro functions of law : derive from macro functions related to a more specific scope to which law is put. -

Defining the limits of acceptable behaviour : major objective of criminal law is to prescribe the limits of socially acceptable behavior and prohibition of murder and violent crimes. An undesirable behavior doesn’t mean that is necessary criminal. Ex. Drinking alcohol is bad but nobody human behaviour is not exclusively regulated by criminal law but also by civil law which is not for punishment but for prohibits you if you are over 18 but it does if you are driving while you are drunk. Boundaries of criminal law differs from one country to another. Activity regarded as criminal in the past doesn’t mean that will be forever. Human behavior is not reulated only by criminal law but also by civil law which is not about punishment of the offender like in criminal but for breaching of a contract.

Defining the consequences of certain forms of behaviour : law doesn’t simply define forms of acceptable behavior but also the consequences . ex. A car accident leads to a person’s injury which seeks compensation.

Defining process for the transaction of bussiness and other activities. : defines procedures by which certain transactions must be carried out .

Creating regulatory frameworks : a vast of regulatory frameworks designed to control activities who provide financial services to the public. Regulatory lawpromotion of health and safety in the workplace and other contexts.

Giving authority to agents of state to take actions against citizens : police has the authority to stop, search , arrest and question you. Social workers have the authority to remove children form a aggressive family environment. The central and local government is given power to take money away from members through taxation.

Preventing the abuse of powers by officials : law is designed to prevent abuses of power by public servants. Officials are not allowed to use discretionary powers in any abusive way.

Giving authoruty to officials to assist the public: a vast range of requirments for agencies of the state to provide services or others good to public.

Prescribing procedures for the use of law : procedural law controls the way in which courts and other adjudicative bodies operate....
