MMP712 – Rating and Statutory Valuation Trimester One 2021 Examination

All questions MUST be answered. Word Count: 2,000 words maximum. Question 1 In the field of rating and statutory valuation, an expert witness has an important role in court proceedings. Describe what type of person may be an expert witness and detail what their role/duties are in a compulsory acquisition case. Use relevant case law to help explain your answer. Provide a guide explaining how an expert witness should conduct themselves in the courtroom and include details on what information should be included in their expert report for court purposes. [15 marks]

Question 2 Explain the reasons why a property valuer could have legal action taken against them for being negligent. Provide examples to these reasons using relevant case law. What relevance, if any, does the API’s Code of Ethics apply to members? [15 marks]

Question 3 (This question has two parts, Part a) and b)) In the State of Victoria, an authority must comply with relevant legislation if they want to compulsory acquire land from a property owner, and in doing so the authority must follow the Land Acquisition and Compensation process. Part a) What legislative timeframe and sequence of events occurs during this process? Part b) Describe the Pointe Gourde principle and use an example to explain how it is applicable in assessing the compensation payable under the Land Acquisition and Compensation Act 1986 for the partial acquisition of a property. [10 + 10 = 20 marks]
