Thus, Betty has power to sell under s57 RPA and has priority to full repayment of her loan ($300k). Betty is required to act in good faith and nothing in the facts suggests that this has not been the case. Therefore, Veronica will be unable to claim damages.

Issue 2: How will the proceeds be distributed? ? Will V’s caveat protect her share in regard to tacking?

The initial agreement includes the possibility of additional payments; however, Veronica’s interest is created prior to the advancement of the second payment ($50,000) from Betty. D. Conclusions, Remedies and Advice Therefore, it would appear that Veronica will be not likely be able to receive any payments from the sale of the property due to the fact that Betty has indefeasible title, thus her interest prevailing. Furthermore, as a consequence of the fact that there was no actual notice per the ruling in Donemore, it is unlikely that Veronica’s caveat will protect her interest pursuant to the tacking....
