With reference to the theoretical and case study materials explored on this module, reflect on how your response to this question has changed since you answered this question in Lecture 1 of Analysing Law. TASK TWO - Client Letter: ADR: mediation, litigation and arbitration Please read the following:Idris Malik is your client. In 2010, Idris left his career as an accountant and established ‘Hubz’, an artisan bakery on the London Road in Leicester. Hubz specialises in producing a range of North African and Middle Eastern breads and pastries and prides itself on using organic ingredients. Idris has been successful in building up a reputation of excellence and has won a number of local and national awards, including the prestigious ‘Best Bakery’ award in 2018. Hubz has been very profitable which has enabled Idris to open bakeries in Birmingham and Nottingham. Hubz also supplies its produce to an extensive network of coffee shops. Since establishing Hubz, Idris has sourced the majority of his ingredients from ‘Eastern Tastes’ - a supplier of fresh olives, spices, nuts and oils. Eastern Tastes is based in London. Over the years, Idris has built up a close working relationship with the managing director of Eastern Tastes, Owais Hussain.

The supply contract between Hubz and Eastern Tastes provides that Eastern Taste will deliver orders to all of Hubz’s bakeries on the first day of each month. The delivery date is crucial to Hubz’s planning and operations and, in particular, to its ability to fulfil its contracts with the coffee shops. In January 2020, Eastern Supplies made a late delivery to Hubz. Idris was able to speak to Owais Hussain who apologised for the delay and promised that it would not happen again. However, late deliveries were made in March and during the initial covid-19 lockdown period which meant that Hubz defaulted on its supply contracts with the coffee shops. Further, in September, Eastern Tate failed to deliver the correct amount of olives which meant Hubz was unable to produce enough olive bread for its customers. Idris is extremely stressed. He has estimated that he has lost around £40,000 - £45,000. To make matters worse, the covid-19 crisis has placed additional pressures on Hubz’s finances. Your supervising partner has asked you to draft a letter of advice on the various dispute resolution methods available to Hubz in resolving this matter. The task is as follows:You need to write one letter: In the letter you will need to advise your client about the strengths and weaknesses of mediation, litigation, and arbitration as possible next steps for resolving this dispute. Conclude by advising your client which one of the three options your client should prefer, explaining why through reference to relevant authorities. Remember that you are advising your client who will need to make the final decision using your advice....
