The legal case that I read about was that Vodacom may lose billions from improper application of intellectual law. This comes after Nkosana Makate who invented the “Please Call Me”, claims that he is entitled to U.S$69.2 million compensation. Please call is an option provided to Vodacom users to send to their loved ones for free. However, South African law states that if an employee creates work that is of benefit to the employer during the time of employment, the work belongs to the employer unless there was a prior arrangement made between the two parties. (Allafrica.com, n.d para 1 & 2). Makate was praised by the company and promised compensation. Vodacom gained millions of dollars through Makate’s invention but Makate did not benefit from any of this.

This case important to the e-commerce business community in a way that individuals need to be educated on their intellectual rights. This man is just an ordinary man who invented something that benefited the company in a big way and they even promised to compensate him but they did not. This happens every day with companies that take advantage of their employees’ ignorance. On the other hand, companies should make use of intellectual rights so as to avoid being sued.
