Fifth and Fourteenth Amendments- very vague, whether it is applicable- think: is it property? Are they State official? It is the process the government must follow to take property. How to adjudicate rights- what can the court do prior to litigation? It is the extent to which state courts can grant prejudgment remedies.  Ex= a student has a full ride to Rutgers Law School with the only condition being that they cannot cheer on Seton Hall. If there is a report the student cheered for Seton Hall at a Rutgers vs. Seton Hall basketball game what is the procedure Dean Chen must follow to revoke the student’s scholarship? (i.e. does he have to give notice or opportunity to present evidence? Who has to sign off on revoking the scholarship?) If the process that is due is not afforded, then the action is void.

Fuentes v. Shevin- Due Process General Rule (Repossession of stove and stereo. Firestone obtained write of replevin. BUT No state shall deprive any person of property without due process!!)  Notice—opportunity to be heard.  Rule 4 Opportunity to be heard must be given at a meaningful time and in a meaningful manner. Individual must be given an opportunity to be heard before he is deprived of any significant property interest.  Due Process 1) Notice must be given (through Due Process) 2) Hearing (pre- deprivation) 3) Meaningful opportunity to prepare 4) Neutral arbiter 5) Counsel States taking property with not enough notice: Public interest 1) Search warrant 2) Towing cars 3) Civil asset forfeiture 4) Taxes/ wartime production 5) Public safety 6) Recall 7) Economic failure
