Constitution of a Juvenile Justice Board Section 4 of the Juvenile Justice Act, 2015, described the constitution of the Juvenile Justice Board. It expresses that the state government shall constitute for every district one or more juvenile justice boards for exercising its function and powers and discharging its functions. The board shall consist of 1. a Metropolitan Magistrate or a judicial Magistrate of first class (not being chief metropolitan magistrate or judicial magistrate) with at least 3 years of experience, and, 2. 2 social workers from 2 different reputed non-government organisation. The selection of members of the board shall be done in the prescribed manner, however at least one member of the board must be a woman and every bench shall have the powers conferred to the board of criminal procedure, 1973 on a metropolitan magistrate or a judicial magistrate of the 1st class. It also states that the magistrate on the board shall be designated as the Principle Magistrate. It is clarified that no social worker shall be appointed as a member of the Board, unless the person has been actively involved in health, education or welfare activities pertaining to children for at least 7 years or is an individual practising with a degree in child psychology or psychiatry, sociology or law. Further, it has been clarified that no person shall be eligible for selection as a member of the board if he or she 1. Has any past record of violation of child or human rights 2. Has been convicted of an offence involving moral turpitude and such conviction has not been reversed or he or she has not been granted full pardon in respect of such offence 3. If he or she has been removed or dismissed from the service of Central or state government or an undertaking or corporation owned or controlled by the Central and State Government 4. If he or she has eve r indulged in child abuse, child labour, or violation of any other human rights or immoral act...
