Prompt: (A) Explain why the facts of *Bethel School District v. Fraser* (1986) led to a different holding than the holding in *Tinker v. Des Moines Independent Community School District* (1969). (B) Based on the facts indicated above about *Bethel School District v. Fraser* (1986) and your own knowledge of *Tinker v. Des Moines Independent Community School District* (1969), describe how the Supreme Court assessed individual liberties in each case. (C) Based on the rulings in *Tinker v. Des Moines Independent Community School District* (1969) and *Bethel School District v. Fraser* (1986), draw a reasonable conclusion about how the Supreme Court interprets the application of the Bill of Rights over time.

Answer: (A) In the Tinker v. Des Moines Independent Community School District case, the Supreme Court decided that wearing black armbands was not disruptive and that it could not be banned by the school district. While the Bethel School District v. Fraser case the Supreme court concluded that Fraser’s behavior was offensive and the school district can discipline him. I can conclude from this that the first amendment protects symbolic speech, which was wearing the black armbands but it does not protect vulgar speech. (B)

The Supreme Court assessed individual liberties in each case by the First Amendment and how limited it can be in a public school. In the Tinker case, the students used their individual rights by symbolic speech that was not disruptive to anyone but for the Fraser case, the court decided that vulgar speech disturbed the public school policies and rules and he was able to get disciplne from the school district.

(C) The Bill of rights is there in the Consitiuution to protect people’s rights from a tyrannical government violation. The use of the Bill of rights in the cases was being interpreted a lot in the court cases because they wanted to make sure that there are boundaries when it comes to the first amendment and they were given the facts of the case so they can come to a fair and just decision. In the Tinker case and the Fraser case, the boundaries of the First Amendment were both constricted and expanded.
