Description

Shaun Martin BLAW 321 Denney v. Reppert Facts  First State Bank in Eubank, Kentucky was robbed on June 12th or 13th, 1963.  Three men robbed the bank of $30,000+  Garret Godby, Johnny Simms and Tilford Reppert later arrested the robbers and recovered all the stolen money.  The Kentucky Bankers Association posted a reward of $500 per robber’s arrest, totaling $1,500.  Many people tried to claim the reward, so the Kentucky State Bankers Association asked the circuit court to decide the most qualified claimant(s).  Murrell Denney, Joyce Buis, Rebecca McCollum and Jewell Snyder attempted to claim the reward, but they were employees of the robbed bank, therefore were ineligible to collect the reward due to their duties of protecting the bank.  Corbin, Julia, Alvie and Gene Reynolds also attempted to claim the reward, but they did not follow the rules of the offer and were therefore deemed ineligible.  Two of the arresting officers were ineligible to claim the reward because it is their legal duty as policemen to arrest them, however, Reppert as eligible to claim the reward because he was outside of his county jurisdiction, therefore had no legal obligation to arrest the robbers. Issue  Which, of the multiple claimants, were the most eligible to claim the reward? Decision  Tilford Reppert was the only qualified claimant due to the lack of legal obligation surrounding him and the arrest of the robbers. Reason  The employees of the bank were ineligible to claim the reward because they had a public obligation to protect their workplace in situations as aforementioned. The Reynolds family were also ineligible to collect the reward because they did not follow the rules of which to collect said reward. Since they did not follow the rules, there was no consideration to make the reward enforceable. Although Tilford Reppers was a police officer and legally holds an obligation to arrest the robbers, he was not in the county of which he is a Sheriff at the time of the arrest, so he was not obligated, legally, to arrest them, therefore resulting in his sole eligibility to collect the $1,500 reward....
