The four functions of the court are the due process function, the crime control function, the rehabilitation function, and the bureaucratic function (Gaines & Miller, 2010). The due process function is to protect individuals from unfair advantages by guaranteeing individuals the right to counsel, the right to a jury trial, and protection from self-incrimination (Gaines & Miller, 2010). The crime control function stresses punishment and retribution (Gaines & Miller, 2010). This function believes criminals should suffer for the punishment they committed within the society. The rehabilitation function is to either help criminals who might be diagnosed with some sickness or to help better criminals to become a member of society (Gaines & Miller, 2010). The bureaucratic function is concerned with speed and efficiency (Gaines & Miller, 2010). This function is more focused on finishing a case before the deadline rather than serving justice. Many conflicts can occur with the court because of the four functions overlapping in certain ways. For example, the rehabilitation function and the crime control function may disagree with each other. The rehabilitation function would try to help a criminal seen as sick and help the individual become apart of society, while the crime control model would try to seek punishment against the criminal and make the criminal suffer. Another example would be between the due process function and bureaucratic function. The due process function believe in protecting the individuals rights, while the bureaucratic function is more focused on meeting the deadline and not providing justice for the individual. Personally, I believe the crime control model is the most important function within the court. There needs to be severe repercussions for criminals who cause harm to society. As stated in the book, this function is used to protect the public, deter criminal behavior, and get criminals off the street (Gaines & Miller, 2010). Out of the four functions, the crime control function seems the most effective.
