AGREEMENT (Objective Manifestation of Assent from Both Parties) mutual assent = “meeting of the minds”. Can be manifested holistically (in one integrated document- Lucy) or through a process of O and A (an exchange of communications). Agreements, to be valid, must have definite terms (what they were going to exchange/intent of the bargain), because if we don’t know it is hard to remedy. Before moving on to the process of offer and acceptance of a valid agreement we must first establish that contracts are interpreted through the objective framework/test = If a reasonable person would believe that the intent to enter a contract was manifested by both parties (what they do/say), then that contract and its terms are binding, regardless of any unspoken subjective intent/state of mind.
