How to write a case note 1. Succinctly introduce the case Intro Names of parties Court which it was decided in Legal significance- what did it change? refer to the Headnotes Was it correctly decided? 2. Outline the material facts of the case
Summarise material facts most important facts of the case -Google case summaries Include any contradictory facts or evidence that arose in the judgment Keep section brief 3. Identify the ratio The reason for deciding The legal principle/rule that decides a case that is binding under the doctrine of precedent
If stuck with the ratio, go on a website called Jade.io – scroll down, green parts= citations, use for the case analysis because they are important 4. Analyse the decision
Don’t just describe it, identify the important part Does it contradict prior decisions? Does it seem logical? Is it consistent? Consider any policy reasons affecting the judgement Be detailed and brief
