Interviewing and Advising - Template Meeting and Greeting   

Good morning _________. I’m _________ and I’m a trainee solicitor. I am supervised by ______ who is a solicitor at the firm.

  

Thank you for taking your time to see me online today. Did you have any trouble connecting to this interview today? As of now, due to the current circumstances, this is the safest way we can help you.

Preliminaries   

So, I understand that you would like some advice concerning ____________. Is this correct? I’m sure we should be able to help you here.

 

I have anticipated that this interview should take about 30 minutes. I have no other commitments this afternoon, do you need to leave at any particular time? Ok, that’s great.

         

In a moment, I will ask you to tell me a bit more background and your reasons for coming to see us today. And then, I will need to ask you a few more questions just so that I have clear and thorough understanding of the facts and what you want to achieve. At that stage, I will take some notes. I would then be able to advise you on your legal position at this moment in time and possible cause of actions which may be available to you. Is this alright? So, before I begin, I must explain the costs for today’s interview. The firm charges my time out at an hourly rate of ______ plus VAT. Now, if the interview takes the fully 30 minutes that I have anticipated, the cost will be _____ plus VAT. Are you happy to proceed on this basis?

Obtaining the Facts  So, please could you tell me about why you are concerned about this director. Filing in the Detail Company - Is the company in existence or is it to be incorporated?  When was the company incorporated? - What does the company do? - Who is the company managed by? - Who are the shareholders?

What are their % holdings? Are there any constitutions (model articles)?

Directors - Who are the directors of the company? - Since when have they been a director? - What are their roles as directors? - Does the company have a chair director? - Are all directors involved with the decision-making of the company? - Are you aware of the financial position of individuals? - Are there any personal interests? - Do they work ft/pt? - Do any of the directors have service contracts? Shareholders & Other Stakeholders - Are there any employees within the company?  

Who gets on with whom? Any close relationships? Those on proposals? Financial position?

I am going to try and summaries what I have understood from the information you have told me. If there is anything that I have gotten wrong or missed out, please do let me know.

Advising -

Keep relating law back to client’s case. Don’t assume client will understand legal terms and jargon.

Client’s Options Apply law to facts of client’s case Think practically and commercially when identifying client’s options.

 Articles of company’s association is the rule book of the company and this is 

where we need to take look to find the legal answers. And, I can see that you have the standard articles and added some of your own.

Closing     

Before I start to round off this meeting, can I just check that there is nothing else that you want to bring up or ask me about? As I have said, I’m a trainee solicitor and my supervisor is ___________. She will be aware of your case, so if there anything urgent that you need, she is the best person to contact. What I will do is send you a letter of everything that has been discussed today. What I would like you to do is to provide me with is evidence of ___________.

What I suggest that we do then is have a follow up meeting, the same time next week? And then we can decide, the next steps to take. Would this be convenient for you?



I estimate this case should take roughly 2 to 3 weeks, however, this is subject to change.

 

On this basis, my charging rate is _____ per hour plus VAT. It is difficult to estimate how much of my time will be taken up and the precise costs at this point of time, especially if we decide to proceed to court. It may well be that it could amount to_, but I will report to you regularly about the costs as the matter progresses.

 
