JUDICIAL AFFIDAVIT I, PETER PARKER, of legal age, single, Filipino, with residence at 1878, E. Quintos Street, Sampaloc, Manila, after having been duly sworn to in accordance with law, do hereby depose and state that: PREFATORY STATEMENT That the taking of my Judicial Affidavit was taken and administered by ATTY. KATRINA RAMACOLA at her law office at 8th Floor Pacific Star Building, Sen. Gil Puyat Avenue corner Makati Avenue, Makati City, 1200. I am answering the questions asked of me fully conscious that I do so under oath and may face criminal liability for false testimony or perjury. I am executing this affidavit in a question-and-answer form, and in English, a language known to me. PURPOSE OF THE TESTIMONY The testimony of PETER PARKER is being offered to prove: (1) all the allegations in the case for reckless imprudence resulting in serious physical injuries, including all the ANNEXES appended thereto; and (2) all matters related thereto. Q1:

Mr. Witness, please state your name and personal circumstances for the record.

A1:

I am Peter Parker, of legal age, single, Filipino, with postal address

at 1878, E. Quintos St., Sampaloc, Manila. Q2:

Why are you here now?

A2:

To give a sworn statement by way of a judicial affidavit, the same to constitute as my direct testimony in the above-captioned criminal case.

Q3:

Are you fully aware of the nature and legal consequences of this oath, and that you may face criminal liability for false testimony or perjury?

A3:

Yes, I am.

Q4:

You are testifying in English. Is it a language known to you?

A4:

Yes, it is.

Q5:

Do you recall what happened last May 28, 2021 at around 8 o’clock in the evening?

A5:

Yes.

Q6:

Where were you at that time?

A6:

I was walking along P. Noval Street in Sampaloc, Manila.

Q7:

Were you accompanied by someone at that time?

A7:

Yes, I was with my friend John.

Q8:

Where were you at that time?

A8:

John and I just got out of Ministop and while we were walking on our way to España, all I remember was I got hit by a car driven by Simon Santiago.

Q9:

Do you know Simon Santiago?

A9:

Yes.

Q10:

How do you know him?

A10:

He used to be my friend because we were blockmates in law school, but our friendship turned sour when I reported that he cheated on the exam. He got kicked out of school.

Q11:

How did you know the car was driven by Simon Santiago at that time?

A11:

He was identified by John and the police.

Q12:

Do you have evidence to prove this fact?

A12:

The Police identified him through the CCTV installed in one of the corners of the street where the incident happened. John later on confirmed that it was the same man who alighted from the car that hit me.

Q13:

What happened after you were hit by the car?

A13:

I was unconscious for a while. When I regained consciousness, I

was already at the emergency room of UST Hospital. Q14:

What happened at the hospital, if any?

A14:

When I woke up, the nurses already gave me first aid but Dr. Ramirez, the orthopedist present, suggested that I should take some tests.

Q15:

What happened after, if any?

A15:

I was not yet confined because I was first under observation for 15 days. I was diagnosed with a complete fracture of the scapular bone of my right shoulder. Dr. Ramirez also prescribed medicine.

Q16:

What happened, if any, after the 15 days that you were under observation?

A16:

On June 12, 2021, I was admitted to UST Hospital because my right shoulder suffered intense pain.

Q17:

Do you have any proof that you were confined on the said date at the said hospital?

A17:

Yes. I have a Certificate of Confinement from UST Hospital. Counsel: We request that the Certificate of Confinement dated June 12, 2021, issued by UST Hospital be marked as “Exhibit A”.

Q18:

Then what happened after, if any?

A18:

My right shoulder was operated on June 14, 2021.

Q19:

Do you have any proof of the operation on the said date at the said hospital?

A19:

Yes. I have a copy of the Record of Operation from UST Hospital. Counsel: We request that the Record of Operation dated June 14, 2021, issued by UST Hospital be marked as “Exhibit B”.

Q20:

How long were you confined at the hospital?

A20:

For more than a month. I got discharged on July 14, 2021.

Q21:

Do you have any proof of the length of your confinement from said hospital?

A21:

Yes, I have a Certificate of Discharge from UST Hospital. Counsel: We request that the Medical Certificate dated July 16, 2021, issued by UST Hospital be marked as “Exhibit C”.

Q22:

Is there anything else you may add to your testimony?

A22:

That is all, Ma’am. Counsel: No further questions for the witness.
