The law affects all aspects of life and established the parameters of acceptable conduct within our society Who can make laws in the United States? -two organizations Common law o Law made by the court o Statutory Law o Law made by the legislature  Congress, State, City Council has a legislature  Statutory Construction means when interpreting a statute, you must look to see how the words are crafted in the law  Bill- someone has an idea in the legislature for a law, the proposal is called a bill  Ordinance-a law passed on a local level  Statute- when the bill is passed in the legislature it is called a statute  Precedent = Stare Decisis

Case of impression = does not have a precedent Social Host liability (Klein v. Raysinger) - liquor liability outside the bar and the person gets hurt  Caption- identifies the parties to the lawsuit  Plaintff- the person that files the lawsuit  Defendent- the person being sued  Appellant (appealed to the higher court)- files the appeal  Appellee (appealed to the higher court)- the person who gets taken to court???  Plantiff’s name usually appears firstl  citation - tells you where case can be found  Court decision = opinion  On the very top of the opinion is a name  Unanimous- when all court justices agree  Majority- most of the justices agree  Concurring- a judge that agrees with the majority for the outcome but based on a different reason  Dissenting- they do not agree with the majority  Affirm- we agree with lower court  Reverse- the lower court was wrong and we will undo it  Remand- the appelate court cannot hear the case, so it will go back to a lower court to have another trial Status and Progress- there is no liability for a homeowner (social host), adult serving to a minor = adult at fault, minor and minor = no liability  ...
