Informed Consent-Case Study Name: XX Read the following case study and answer all the questions below, then upload in blackboard under “WEEK 5: EVENT REPORT DOCUMENTATION” The RN is caring for a 62-year-old female patient who presented to the emergency room with nausea, vomiting, fever and abdominal pain in the URQ. After diagnostic testing and general surgery consult it was decided she will require a laparoscopic cholecystectomy. The surgeon states the patient is ready to sign the surgical consent.

1- What is an informed consent? Informed consent is a legal process by which a client or the client’s legally appointed designee has given written permission for a procedure or treatment. Consent is informed when a provider explains, and the client understands:  The reason the client needs the treatment or procedure.  The risks involved if the client chooses to receive the treatment or procedure.  Other options to treat the problem, including not treating the problem 2- What information regarding the patient’s neurological assessment is crucial before a patient is to sign an informed consent? The person who signs the form must be awake, alert, and oriented times four, mentally competent, and capable of understanding the information from the health care professional who will perform the procedure. The person must be able to communicate with the health care professional.

3- What is the nurse’s responsibility regarding informed consent? The nurse’s role in the informed consent process is to witness the client’s signature on the informed consent form and to ensure that the provider has obtained the informed consent responsibly. This means the nurse must:  Ensure that the provider gave the client the necessary information.  Ensure that the client understood the information and is competent to give informed consent.  Have the client sign the informed consent document.  Notify the provider if the client has more questions or appears not to understand any of the information. The provider is then responsible for giving clarification.  Document questions the client has, notification of the provider, reinforcement of teaching, and use of an interpreter.

4- When can informed consent be overridden? Several ethical obligations can, in certain circumstances, override or set limits on the requirement to obtain informed consent. For example, strong claims for the public good (specifically, public health) may set limits to what a patient can refuse or choose (Informed Consent, 2009) under certain conditions such as where there is temporary or permanent mental incapacity due to unconsciousness, infancy, or severe mental retardation.
