The information contained in the following report will address the privacy breach or hacking incident that occurred against Mountain Top View, Inc. Mountain Top View, Inc. is a sole proprietorship organization which, Clare Applewood the owner, is solely responsible for and manages the day-to-day operations and it profits. We will review the incident to determine the ethical and or legal obligation Mountain Top View, Inc. may have to its customers. We know that ethics are moral principles that govern a person’s behavior and actions (Kubasek et al. 2020). A person’s personal values play an important role in ethical decision making which can be derived from culture, tradition, philosophy, religion, or law. In comparison to law, ethics can be understood as the moral compass the guides decision making whereas laws guarantee personal freedoms while serving as a moral guide for human conduct. From this incident, it is important that we evaluate our corporate social responsibility since it is our customers and community that was impacted. Corporate social responsibility consists of expectations that communities impose on organizations for doing business inside its borders and thus it is reasonable to expect that MTV’s customers would expect a level of privacy for doing business with MTV’s. The incident itself was unfortunate, but the ethical dilemma came into play when Steve, MTV’s Technology Lead, first noticed the but failed to report it. Ethical business practices usually take into account the organizations and customers best interest while obeying the applicable laws i.e. Foreign Corrupt Practices Act. In our situation, Steve was not acting in the best interest of MTV nor its customers since. Summary of the ethical and legal issues MTV faces: 1. Steve, Technology Lead put business interest before customer interest by not reporting incident 2. Civil liability from customers who were impacted by the privacy breach

The relevant stakeholders would be owners such as Clare Applewood, employees (Steve/Carlos), customers, and general community where MTV operates in. Key Facts and implications: 1. Mountain Top View’s website includes a statement “We are committed to keeping customer information secure and protected” 2. Mountain Top View employee (Steve) came across the hacking incident but failed to report the matter. 3. Since Steve is acting as an agent of the organization, Mountain Top View can be perceived as knowingly covering up the incident 4. Civil liability from customers who were impacted by the privacy breach Recommendation: It is recommended that Mountain Top View take quick action by immediately reporting the incident to its customers both that were impacted and those that were not by the data breach. It also important to note, since the incident is considered to be computer crime, a crime in which computers were used to commit a crime, which is a violation of the Counterfeit Access Device and Computer Fraud and Abuse Act, customers would have legal obligation to know they were a victim of a crime. Legal authorities would also have to be notified so a formal investigation can be started. Conclusion: Advances in technology in today’s business world can have both legal and ethical implications. For example, ecommerce or the shopping of goods and services through online platforms, have led to increases in legal and ethical issues for business. Most transactions involve the transferring of consumer information, most of which can also be considered private. The

legal issue that comes into play is how well and secure can businesses safeguard information against computer crimes or hackers. From an ethical perspective, businesses must persist on the doing what’s right for its owners and customers even in uncertain citations, like the Mountain Top View incident.
