In a park near your school, there is a pond that freezes over in Jan & Feb. You take your class to this playground for an alternative environment activity. (Lunch and game of capture the flag). During free time after lunch, one student fell through the ice. Describe the specific actions or issues around the topic of “safe environment” that would determine whether or not the teacher met his or her “standard of care”.

The teacher did not meet her or his “standard of care” as she/he took their class to an area with unsafe environment conditions. Prior to taking the class to the park, the teacher should have inspected the environment to ensure it was a safe playing area for the students. While inspecting the environment, the teacher should have noticed the frozen pond and realized this was not an appropriate safe area to take their students to. If they did realize it could possibly be dangerous and the teacher brought their students to the park anyway, then the teacher was negligent, failing to take proper care of their students. Or, the teacher should have controlled for the risks that can’t be removed and set clear boundaries for the students, so they stay away from the frozen pond. !

2. A teacher wants to take her class skiing this winter. She has a keen parent who will organize things and the funds are in place from a successful fundraising campaign in September. List at least 5 questions this teacher should gain answers to in order to determine whether skiing is an appropriate activity for her class.

- Do the students have any experience skiing? - Do the students have proper equipment that will allow them to participate? - Does the teacher have enough supervision for their class to bring them skiing? 3. A teacher is discussing with a principal the possibility of a snowshoeing day on Seymour Mt. The principal asks the teacher for reassurances that “supervision will be adequate for this outing”? Reassure the principal (5 points).

- Quality supervision, the teacher will have supervisors who have necessary certification (ex: first aid certification) - Quantity of supervision, the teacher will have necessary student:teacher ratio (ex: 5 students to 1 teacher, whatever it may be according to the school) - With the necessary student:teacher ratio, all students will be supervised at all times and not be left alone during their time off school grounds. - General and specific supervision, the teacher will have an emergency action plan ready in case of any emergency situations that may occur. - The teacher will make explicit behaviour expectations to their students prior to the snowshoeing trip, so students are aware the appropriate ways to behave while they are on the outing.

4. Describe how a teacher can use information processes and district policy to “transfer risk.” Who is s/he transferring it to in each of the five case you describe? (5 points).

There are a few different ways that a teacher can transfer risk: - Inform participants about the risks involved and have the participants sign waiver, which makes them reliable for the risks. - However, if a teacher is dealing with young students under the age of 18, they cannot sign a wavier, so the teacher would need to get the parents to sign a consent form for their child to participate in the activity. - The teacher could also get insurance. For example, travel insurance in case a students get injured, the insurance will cover the cost of any medial bills or damages. - Another way to transfer risk is to hire a third party. For example, when we went to Climb 5 for rock climbing, the teacher (you) hired a third party to cover any risk that could occur. - Or if an accident occurred, they can sign a release form which will transfer risk and you are no longer liable for any damage or injuries that may have occurred.
