2.0 INTRODUCTION First of all what is land surveyor department in property? Land surveyor are a necessary tool for identifying property strains and the area of a property's features. Without land surveys, there would be no way to recognize the place one piece of land ends and the different begins. While modern-day property disputes might also no longer result in the identical stage of war as they did centuries ago, it is important for everyone to recognize who owns what. It is Estate Agent and Land surveyor work together. Yes, but the property must be vacant or necessary. The role of Estate Agent is they provide a service in buying, selling, leasing properties for clients so that, optimum returns can be achieved. So how about Land surveyor for the role of Land Surveyor is to conduct measurements and evaluations of sites for public, authorities and private property. The responsibilities of land surveyors consist of developing land survey reports and performing calculations of measurements and evaluations.

3.0 SUBJECT PROPERTY

Based on the picture above, Diagram 1, shows that a logo of our Subject Property is called “Polaris Geoland Survey & Consultant SDN BHD”. Its located at Nong Chick Riverside Commercial Jalan Kolam Air 2, Taman Nong Chik, 80100 Johor Bahru Johor. This building adjacent to the famous school in Johor Bahru which is “English Collage”.

“Polaris Geoland Survey & Consultant SDN BHD” is a professional land surveying firm that has been in operation since 2010 and specializes in land surveying and land development consulting. The firm is licensed by the Malaysian Board of Land Surveyors and the Ministry of Finance.

Engineering Survey, Strata Title Survey, Cadastral Survey, GPS Survey, and Topographic Survey are some of the land surveying services offered by Polaris. Aside from land surveying, the firm also handled a wide range of land administration applications, including subdivision, lot partition or amalgamation, state land application, housing development, and commercial development. In early of 2021, “Polaris” had a high voltage survey at Johor Bahru .

Siti Zaharia Binti Mapak, Director of Polaris Geoland Survey & Consultants SDN BHD, led this firm. This company has 12 surveying teams and three office teams. Each team consists of 4 to 5 people who must work together to provide the best professional services to clients.

4.0 INTRODUCTION OF LAND SURVERY The land surveyor was established on as a profession on 1885 with their own department.Before March 1961, there are two professional bodies representing surveyors, The Malayan Institution of Surveyors (former Rector of IKI Malaya Branch) and the Institution of Land Surveyors. The history of the surveyors was made on March 13, 1961, when they met at the Royal Selangor Club Council has made to establish the Institution of Surveyors (Federation of Malaya). Geomatics and Land Surveying Division, Quantity Surveying Division, Property Surveying Division, and Building Surveying Division are the four divisions that make up the Institution. The Divisional Chairs are members of the Institution's governing body, the General Council. The General Council, whose members are elected annually, oversees the Institution's affairs. The Institution's affairs are directed and managed by this General Council, which is presided over by a President. In a nutshell, the Council's work is divided into two categories: matters of national and public interest for which surveyors are uniquely qualified, and matters relating to the Institution's internal organization that affect membership. Election of Members, transfers to the class of Fellow, and enrolment of Students and Probationers are all covered by the Constitution. It also establishes the Institution's authority to conduct professional examinations and the establishment of Branches in Malaysia's various states. The Institution currently has five branches: Sarawak Branch, Sabah Branch, Johor Branch, Northern Branch, and East Coast Branch, as well as a chapter in the United Kingdom. Land surveying it is was an important process especially towards estate agent works regarding to the properties.Such as to determine the boundaries mark of the land.This survey has be done to find or locate, specify , monument and make a map of the boundaries and also the coners of a parcel of the land.This survey was carry out by professional land surveyors that be trained.

5.0 KNOWLEDGE OF LAND SURVEY THAT MUST HAVE ON ESTATE AGENT IN PRACTICE.

Having knowledge regarding land survey will give advantages to an estate agent in practice. This knowledge also important to an estate agent since it related to each other This situation will able to see when during the process of transaction properties. An estate agent should know the information welly either the information is true or not. The most important of information is a title, in a title an estate agent will able to know the information regarding the properties. In a title, it comprises all information such as land area, building area, landowner and etc. This report will be more focused on a land survey, so the land area can be related as an example of a land survey. Commonly people will know the land area of land if refer under the title. But as an estate agent, he or she must make sure the land size area is the same as the title. This must be done to make sure the transaction of the properties is smooth and to avoid anything bad in future that can affect an estate agent. From this situation, it shows how important the knowledge of land survey in estate agent practice. An estate agent should know the basic of the land survey only, it doesn’t mean an estate agent can take over the roles of the land surveyor. For example, an estate agent can measure the using the tape measurement by measure the boundary mark from one point to another point if the boundary mark is still on the land. But if the landmark is disappeared or the position is to change the estate agent must ask the landowner to hired the land surveyor to plot the boundary mark again. The estate agent can observe the land surveyor while they are doing the work in a good manner. The reason is maybe some of the landowners will hire the land surveyor with extra money as long as the land survey measures the land bigger than the actual size so that they can get the benefit.As an estate agent they should have a knowledge in land surveyor even though this is not in their practise, but to be a good an estate agent knowledge it is very important.By having the knowledge an estate agent will not easily manipulated with other parties for their own sake instead it also give an advantage to an estate agent to do work more smoothly.

6.0 ROLES OF LAND SURVEY IN PROPERTIES

6.1 Determine the size of the land area 

Based on National Land Code,1965 there are two types of title which is qualify title and final title.The different of both title is in term of measurement size of the land.The land area of certain properties usually stated in the qualified tittle (hakmilik sementara) The reason why the owner do not get the final title it is because final it takes time.That is why the owner get qualify title at that first.In this cases the land surveyor will measure the size of the land twice, which is at qualify title and final title.In qualify title the land measurement is not accurate or not details compare to final title.But the owner still have a right same as final title, so the estate agent will get the correct details of the properties.

6.2 For subdivision and partition land 

Surveyors will play their vital which is to measure the subdivision and partition land. Subdivision is a process of the breaking up of an alienated land two or more partitions held under a final title but each land to be held by the same proprietor or same co-proprietor. Upon completion of the subdivision, portions will be held under separate titles with the same title of the proprietor or the same co-proprietor. This process must be done by a land surveyor to determine the exact boundary mark to avoid wrong information or any problem to do transaction on the land.For example, Ali has 1 acre of land and he do the subdivision to three portion and every each portion will 1/1.From this situation, it will make the estate agent work more easier to handle the process of the transaction of the land if the landowner want sell part of the land not the whole land. Then,partition is process that involves the dividing of land into portions.This partition happen when the landowner which is among of co-proprietor want separate title and plan of the land to avoid any problem regarding to their boundary.So the roles of surveyors is to help an estate agent to make their work easily,if one of the co-proprietor want to sell his part of the land there is no problem happen since one of each co-proprietor have their own title. For example, the vast land will be divided into an individual title such as from one-acre land, surveyors will breaking up the portion into 6 lot of bungalow house individual title.

6.3 Get the plan of properties 

Plan is a visual drawing of land or properties on a paper or form of digital file. An estate agent needs a plan to value a property with right information and method of calculation.Usually after subdivision or partition any land, it will have the new plan, so an estate agent needs that plan. For example, condition to build a bungalow house in Negeri Sembilan needs extra width 50 ft. Then, after the surveyor done drawing the plan, it will submit and authorized by municipal council.If the land is pass the condition for build a bungalow then they can proceed it. This very important to estate agent in selling or buying of the property, an estate agent should know the exact information.Which is the building that been develop on that land was follow the specification as stated according to municipal council.

6.4 To determine the mark of land 

Some cases happen when boundaries marks on land were difficult to find, the mark, already sunk in the ground, land boundaries that have been lost or shifted from the exact place regarding changes of the structure land. The boundary mark on land is very important even though the landlord has the title with the detailed measurement. But this will affect an estate agent to know the actual size of the land because an estate agent cannot determine the size only by looking at the title. As an estate agent, they must know where are the boundaries marks located if the principal wants to sell or buy the land to avoid any problems happen soon if any development be done or the plantation enters someone else boundaries. If this happens it would involve a cost to demolish what has been done and automatically the buyer will point out the fault at an estate agent. Indirectly the reputation of an estate agent will get a bad perception from other people. From this situation, the landowner should hire the land surveyor to measure again the land.

6.5 Determine the topography of land 

Topography is the study of the shapes and characteristics of land surfaces. Surveyors are skilled in this field where they can know the description of the land. Before starting any construction of buildings or properties, it is important for surveyors to determine the characteristics of the land. If the land is uneven, so the landlord can flatten the land evenly and can start to build a building or property on that land. The topography of the land is also important information to the estate agent. As an estate agent, they should know the description of the land before selling or buying the land for the principal. For example, if any potential buyer asking regarding the land the estate agent can suggest or give an idea of what kind of development is suitable for the land according to the topography of the land.

7.0 THE PERSON THAT ESTATE AGENT REFER FOR LAND SURVEYOR An estate agent must gather all the information in the right way. Everyone knows that even though the person does not have the qualification but they have the knowledge regarding that profession, but they still practice it in an illegal way. To avoid this situation happen we can refer to authorized parties to refer to the person who is been registered.

An estate agent can get exact information regarding who conducts the land surveyor with the license at Lembaga Juruukur Tanah Malaysia.Lembaga Juruukur Tanah Malaysia was located at Wisma LJT, Aras 5, 7, Lorong Perak, Pusat Bandar Melawati, 53300 Kuala Lumpur.Lembaga Juruukur Tanah Malaysia also has their own website, which is on this website the are so information regarding the land survey. It can be a search name using the alphabet.Other than that, this website also already categorized the land surveyor according to the state available in Malaysia with the specialty of the surveyor that can be done by them.At the same time, the location and phone number also provided to contact the land surveyor.

Based on the information it gives the advantages to an estate agent to get the information by only visit the website. In directly the estate agent can save the cost in terms of car petrol and traveling cost if the distance estate agent office quite far to go to Lembaga Juruukur Tanah Malaysia.Lembaga Juruukur Tanah Malaysia was located at Wisma LJT, Aras 5,7, Lorong Perak, Pusat Bandar Melawati, 53300 Kuala Lumpur.

The second advantage is a safe time, since the estate agent does not have to travel to get the information an estate agent can proceed with the work faster. For example, if the estate agent needs to sell the owner's land but the boundary mark is unseen so the landowner must hire the land surveyor to mark the boundary back. So if the estate agent has the information about who the person is legally practicing the land surveyor it can save time to make the listing of the land. At the same time, the reputation of the estate agent also increasing in a good way.

8.0 METHODS TO MEASURE THE PROPERTY OR LAND NORMALLY IN PRACTICE

The cadastral system is a system that can carry out the relationship between land, humans, and law in daily land management. Where this surveying undertaken to produce plans of property boundaries for legal purposes. In many countries the registration of ownership of land is based on such plans while, in Malaysia, cadastral surveys has been conducted by Department Of Survey and Mapping (JUPEM) and license surveyor firm.

Cadastral surveys are commonly used to divide land into parcels for ownership under a land title, as well as to re-establish boundaries of previously surveyed properties to determine the physical extent of ownership or to facilitate the transfer of the property title.

Cadastral surveys have undergone changes in the era of sophistication technology with the use of measuring equipment such as Total Station and Global Navigation Satellite System (GNSS) to determine boundary positions and control points. Nowadays, advances in computing and ICT technologies have also changed field observation work, calculation, review, and preparation plan drawing to the latest methodology.

8.1 PROCEDURE OF LAND SURVEY Surveyors are frequently seen working outside, such as when highways are realigned or new housing developments are being built.
