QUESTION 1 Go to https://www.fairwork.gov.au/employee-entitlements/national-employment-standards and identify the award provisions for: 1. Leave including shift workers (50 – 75 words) Full time and part time employees get 4 weeks of annual leave. Based on their ordinary hours of work. To get 5 weeks of annual leave a shiftworker has to be: -

A 7 day shiftworker. Employed in a business where shift are continuously rostered 24 hours a day. 7 days a week and is regularly rostered to work those shifts. Regularly rostered to work on Sundays and public holidays.

2. mandated breaks between shifts (25 – 50 words) Employees have to get a minimum break of 10 hours between finishing workon one day and starting work the next day. An employer can reduce the break to 8 hours when there is a changeover of rosters. 3. maximum allowed shift hours (75 – 100 words) full time maximum hours the maximum number of ordinary hours a full time employee can work is -

11.5 hours in a day 10 hours in a day, if the employee is under 18 years old Average of 38 hours over 4 weeks.

QUESTION 2 You employ 3 chefs. John is casual, Jack is part-time and Chenelle is employed full time. They all arrive for the morning shift. After 1 hour a storm hits the restaurant and the power goes off. The manager informs staff that they shall clean up and leave as power will be off at least for 2 days. After 1.5 hours all staff leave. What is their pay entitlement for that day? (25 – 50 words) Each time a full time, part time or casual employee works they have to be given at least: -

Jury service (25 – 50 words) An employee, other than a casual employee, has to be paid “make-up pay” for the first 10 days of jury selection and jury duty. Make-up pay is the difference between any jury duty payment the employee receives from the court and the employee’s base pat rate for the ordinary hours they would have worked. The employer may request evidence that the employee has taken all parts to obtain duty pay and of the total amount of jury pay they will or have received for that period.

Long service (25 – 50 words) Each employee is entitles to long service leave after working for the same employer for 10 years or more. Specific entitlement and conditions vary from state to state.
