WEEK 3 – TUTORIAL QUESTION 2 Assignment Read the following facts and then answer the questions below: Alena Williams is a lawyer who is admitted to practise in your jurisdiction. She has a valid practising Certificate. She is handling a legal case for her client, Ms. Patterson which deals with property damage. Ms. Patterson’s neighbor was cutting down a tree and the tree fell on Ms. Patterson’s house and damaged the entire roof. The civil suit was filed in the High Court and the matter is listed before a Judge. On the few occasion that the matter was listed on the Court list, Alena failed to show up to court without informing her client or judge, failed to file documents on time, failed to inform Ms. Patterson of the legal fees that would be applicable and then sent her a huge legal bill. Alena was summoned to Court by the Judge and when asked about her nonappearance, Alena explained that she had been attending to some urgent orders for domestic violence protection in the Magistrates court. The Judge enquired with the Magistrates Court and found out that Alena did not have any matters listed on the dates that she failed to appear in his Court.
