In July of 2009, David Marmolejo was convicted by a jury of 12 peers in the strangulation and brutal murder of his own mother for 54 years. “.David Marmolejo wife, Laura Marmolejo, also took the stand Tuesday to tell jurors about David Marmolejo alleged violent tendencies. She described an incident in April 2009 in which she accused David Marmolejo of choking her in the garage of Gloria Marmolejo East Side home until she passed out” (1)i There were many taboo twist like David’s girlfriend/sister-in-law. I believe her own presence came into accountability when, their brother Manny Marmolejo, said ” The family's fight for justice isn't over yet. They said they plan to pursue legal action against David's stepsister and girlfriend at the time of the murder, Mariah Wilson, who admitted she helped him cover up the crime and dump Gloria's body in the desert.”ii

There seems to be a jurisdiction issue when the body was moved. There was a surrounding community of law enforcement that all tried to work together to make sure the conviction was maintained. The mother’s body was found

in a New Mexico desert around Santa Teresa, but found by non-local authorities.

He was legally able to be tried twice, for preponderance of the evidence, and then the Murder charge. The judge wanted to hear cases of prior abuse and violence against his mother and ex girlfriends. “A pretrial hearing took place Friday afternoon before District Judge Gonzalo Garcia to determine whether he would allow testimony from the women about David Marmolejos alleged abusive behavior during his second murder trial in March in San Antonio. His first trial ended on Oct. 17 when a jury of seven women and five men deadlocked.”iii He had the opportunity to appeal in different venues like New Mexico (Santa Teresa) or Texas depending on the type of spin he wanted to put on the locations and details of the body.
