Amendments of Statements of Case (CPR 17)

Before service

Amendments can be made to statements of case at any time before service (CPR 17.2)

After Service

Statements of case can only be amended by: (a) written consent of all of the parties  court has the power to disallow the amendment (CPR 17.2); (b) permission of the court On making the application to amend the statement of case, the applicant should: (i) file the application notice; together with (ii) a copy of the amended statement of case 

if granted, the amended statement (with the court's endorsement on it) will be served on all parties, along with a copy of the court order.

What will the amended statement of case look like?  First amendments are marked in red and are underlined  Second amendments are marked in violet and are underlined  The statement of case will be endorsed with the words: "Amended [type of statement of case] by Order of [name of master/district judge] dated [insert the date]"  Amendments must be verified by a statement of truth unless the court orders otherwise (CPR 22.1(2))...
